No person shall intentionally injure any pavement, sidewalk, sewer, catch basin, crosswalk, drain, gutter or public ground, nor shall any person dig, make or cause to be dug or made any hole or excavation in or under any public street, avenue, alley, sidewalk or ground unless a written permit to do so is first obtained from the Superintendent of Public Works.
Application for a permit required by § 214-21 shall be in writing and subscribed to by the applicant and shall specify the object of the proposed excavation, the location thereof, the name of the person for whom the work is to be done and the name of the contractor, if there is one.
A. 
Required. The Superintendent of Public Works may exact security for the restoration of any public street, avenue, sidewalk, alley, lane or ground, either by a bond or guaranty of some responsible party or by requiring a deposit with the Village Treasurer of a sum of money deemed by the Superintendent to be sufficient security for such restoration.
B. 
Return. The security required by Subsection A shall be returned when restoration of such street, avenue, alley, lane or ground is completed to the satisfaction of the Superintendent of Public Works.
C. 
Security not release from liability. The giving of security or money shall not be held to relieve any party from liability under any legislation of the Village.
Where excavation has been made in or under any public place and such street, avenue, sidewalk, alley, lane or public place has not been restored and left in condition deemed by the Superintendent of Public Works to be as good, substantial and permanent as before such excavation, the person making such excavation shall restore such public street, avenue, sidewalk or place to a condition deemed by the Superintendent to be as good, substantial and permanent as before such excavation, within five days after written notice shall be served upon such person, firm or corporation requiring him to do so. If after receipt of such notice said person shall fail to restore such public street, avenue, sidewalk or place as herein provided, the bond provided for in § 214-23 shall be forfeited, and the Superintendent of Public Works shall be empowered to complete the work.
All excavations in or under any public street, avenue, sidewalk, alley, lane or public place shall be surrounded by suitable barriers or guards for the protection of persons using such areas in the daytime and, in addition thereto, by lights or flares from twilight continuously to daylight.
No person shall unlawfully tear down, carry away, remove or in any manner interfere with any barricade or light placed upon, around or in any excavation, street improvement or obstruction in or under any public street, avenue or sidewalk, so placed by any employee of the Village or any owner thereof or any contractor to protect the public or to prevent injury to such public work.
Any person violating any of the provisions of this article shall be guilty of a violation and, upon conviction thereof, shall be punishable by a fine not exceeding $250 for each offense or imprisonment not exceeding 15 days, or both such fine and imprisonment.
The fee for an excavation permit shall be $25.
