No dog or other domestic animal or pet of any
kind or description, except a domestic cat, shall be permitted at
any time:
A. To enter or remain in any store, restaurant or public
building in the village.
B. On any walk, road or public place in the village,
unless such animal or pet is accompanied by and under complete supervision
and control of a person of suitable age and discretion, who shall
at all times lead and keep such animal or pet under such supervision
and control by means of a suitable leash, strap, cage or other effective
means of preventing the same from being at large.
C. On any beach or on any municipal recreational area
of the village, except that dogs may be permitted to run loose on
the oceanfront beach within the village between September 15 and May
15, when accompanied by and in control of a person of suitable age
and discretion capable of completely controlling the dog, and be maintained
within that person's view and immediate control, and that person shall
be responsible for the dog or dogs and be deemed supervisor. Said
dog or dogs shall not be permitted to defecate upon the beach, and,
in the event that the dog shall defecate, the product or result of
such defecation shall be immediately removed by the supervisor. Said
dog or dogs shall not be permitted to intimidate or annoy any third
party in which event, upon a complaint to the dog's or dogs' supervisor
that such third party is intimidated or annoyed, the dog or dogs shall
be immediately releashed and removed from the beach.

No person owning, harboring or having custody
or control of any animal shall, at any time, permit it to make any
excretion upon any common thoroughfare, sidewalk, passageway, play
area, park, beach or any place where people congregate or walk, or
upon any private property without the permission of the owner of said
property. However, in the event that any animal shall soil, defile,
defecate on or commit any nuisance in any of the above prohibited
areas, the person owning, harboring, keeping or in charge of any such
animal shall immediately remove all feces deposited by such animal.
The feces removed shall be deposited in a closed garbage container
by the person owning, harboring, keeping or in charge of such animal.
In addition thereto, the person owning, harboring, keeping or in charge
of any such animal shall, at all times when said animal is upon any
common thoroughfare, sidewalk, passageway, play area, park, beach
or any place where people congregate or walk, or upon any property
whatsoever or upon any private property without the permission of
the owner of said property, have visibly in his or her possession
a contrivance, tool or device to be used to scoop or pick up any feces
which may be caused by such animal. Such contrivance, tool or device
shall be constructed of durable metal or plastic material and shall
contain or be accompanied by a disposable container for depositing
the feces.
No person owning or having custody or control
of a cat shall permit such cat to run at large within the corporate
limits of the village, unless it is provided with and wearing a harness
or collar to which is securely attached a bell of sufficient size
so as to give adequate and audible warning for the protection of birdlife.
No person shall, at any time, abandon any cat,
dog or other domestic animal or pet of any kind or description within
the corporate limits of the village.
No person shall, at any time, induce animals
or pets of any kind or description to fight at any place within the
corporate limits of the village, or within 1,500 feet of the shoreline
of the village.
No person shall permit any horse, donkey or
other dray animal to walk upon the public walks, dunes or beaches
within the village or upon the beach fronting on the Atlantic Ocean,
within 1,500 feet of the shoreline of the village.
If any dog, cat or other domestic animal or
pet of any kind or description shall be found at large within said
Village of Ocean Beach, in violation of this chapter, it shall be
lawful for any policeman, trustee or other officer of the village
to seize and impound the same. Any such animal or pet so impounded
shall be confined for a period of five days and may be redeemed by
the owner thereof within said period upon payment to the Village Clerk,
or to such other officer as may be designated by the Board of Trustees
of the village to be in charge of the public pound, of a fee of $5;
and any such animal or pet not redeemed within said period of five
days may, without notice, be destroyed or disposed of.

The owner of any animal or pet, and any person having custody or control of such animal or pet, shall, upon conviction, be subject to the penalties set forth in Chapter
1, General Provisions, §
1-14.

It is hereby found and declared that the presence
of large numbers of rodents, wild deer and other wild animals within
the village constitutes a health and safety hazard to the inhabitants
of the village in terms of the danger of the transmittal of disease,
physical injury to the people and damage to property. It is the intent
of the Board to mitigate these dangers by restricting the availability
of feed or other inducements to attract such wild animals into the
village and thereby limiting the potential damage and dangers imposed
by their presence.
As used in this Article, the following terms
shall have the meanings indicated:
ANIMAL FEED
Any food or any material used as a food for any animal.
WILD ANIMALS
All rodents, deer and dogs but excluding any domesticated
animal owned by a resident of the village and for whom that resident
of the village has assumed specific care and allows the animal to
reside within her or his premises.
