The Board of Trustees of the Village of Ocean
Beach finds it to be in the public interest to regulate ownership
and control of property situate and lying in a certain area immediately
adjacent to the Great South Bay, for the recreational use, quiet enjoyment,
public health, safety and welfare of residents of the village. In
accordance with and pursuant to the Village Comprehensive Plan and
the General Management Plan of the Fire Island National Seashore,
the provisions of this article are hereby enacted.
No land, building, structure or premises or
any part thereof shall be used, occupied, erected, expanded, changed,
converted, constructed or altered for any commercial use, nor shall
any commercial store, shop or other commercial establishment be permitted.
The Bayfront Recreation District shall be within
the territorial limits of the Village of Ocean Beach northerly of
the boundaries herein described: Beginning at the easterly boundary
of Ocean Road and the entire westerly boundary of Parcel 1 in Block
2, and running thence eastward along the southerly boundaries of Parcels
1 and 37, Block 2, to the westerly side of Bungalow Walk; running
thence easterly, from the easterly side of Bungalow Walk, along the
southerly boundaries of the playground (Parcel 38, Block 2) to the
westerly side of Cottage Walk; running thence easterly, from the easterly
side of Cottage Walk, along a line 83.5 feet north of Bay Walk through
Parcel 1, Block 3, thence easterly 37 feet north of Bay Walk through
Parcel 2, Block 3, thence easterly 71 feet north of Bay Walk through
Parcel 3, Block 3, thence easterly 44 feet north of Bay Walk through
Parcel 34 to a point 46 feet north of Bay Walk on the westerly side
of Denhoff Walk; running thence easterly, from the easterly side of
Denhoff Walk along the northerly boundaries of Parcels 37, 38 and
39, Block 3, to the westerly side of Bayberry Walk; running thence
easterly, from the easterly side of Bayberry Walk, along the northerly
side of Delivery Walk to the westerly side of Ocean Breeze Walk; thence
northerly along the westerly side of Ocean Breeze Walk to the Great
South Bay.
The amended Zoning Map of the Incorporated Village
of Ocean Beach shall be amended to conform to the provisions of this
article.
