When any and all applicants seek any approvals from either the Egg Harbor Township Planning Board or the Zoning Board of Adjustment regarding any type of development under the Municipal Land Use Law,[1] that applicant shall incorporate into his application site plans identifying type and location of existing and proposed streetlighting in accordance with municipal requirements. Where such development does not impact on public streets, impact being determined by the Board, the requirements of this chapter may be formally waived by the Board. Where the Board does not grant a formal waiver, it shall be a condition of all approvals granted that the applicant comply with the provisions of this chapter.

The Board before which the applicant is appearing shall receive streetlighting designs and plans from the applicant and review the same, taking into consideration current and future lighting needs at that site as well as the operational costs of the lighting which the Township may ultimately have to bear. The recommendations of the Board shall be submitted to the Township Committee, for its action within 30 days of receipt of the Board's recommendations. In all applications where the development shall be built in phases, the Township Committee shall establish time frames for the installation of streetlighting. The Township Committee's determination and authorization shall be provided back to the approving Board and the applicant.
The applicant shall be responsible to pay for all installation costs applicable to the approved streetlighting, said costs determined by Atlantic Electric Company. The applicant shall issue a check made payable to Atlantic Electric Company and deliver that check to the Township Clerk for official transmittal to Atlantic Electric Company. The applicant shall pay to the Township of Egg Harbor the cost to operate each streetlight for a period of one year commencing upon the installation of each streetlight(s). The operational costs for electricity shall be those rates charged by Atlantic Electric Company. Any pending applications for a streetlighting permit where construction commenced prior to the effective date of this chapter, the application shall have until June 1, 1990, to comply with the herein contained provisions.
Each year until the improvements are accepted by the Township Committee, the applicant shall continue to pay one-year operating costs, in advance, to the Township of Egg Harbor for each streetlight in operation. The installation anniversary date shall begin the time period for future payments. This payment for operation shall continue until such time as the street upon which said lights are installed shall be accepted by the Township Committee of the Township of Egg Harbor as a public street.
The Township Clerk shall charge an administrative fee applicable to each application for municipal streetlighting. The fee shall be $10 per fixture. Any and all administrative costs or charges assessed by the Atlantic Electric Company to the Township of Egg Harbor shall be paid by the applicant who shall be responsible and pay the same within 20 days of receipt of billing.
The applicant shall bear the full cost of installation and construction of all new streetlighting or any change to the existing streetlighting necessitated by the development or other construction. The furnishing of an adequate performance guaranty may be required as a condition of approval.
The streetlight plan recommended by the applicable Board and approved by the Township Committee may provide for installation and operational start-up of the streetlight on a phased basis, and observation of the installation by phases shall be the responsibilities of the Township Engineer, with those costs charged to the applicant's developer's escrow account established with their development application.
The applicant for streetlighting on an existing street shall complete an application providing the pole location for which the streetlight is requested, the pole number and the basis for requesting the streetlight. The application shall be received by the Police Department who will determine if a need exists for streetlighting, as requested, and will submit a report recommending approval or disapproval. The report will be based upon proximity to other streetlights, condition and curvature of the road, proximity to other lighted areas, as well as road condition, traffic considerations and other guidelines pertaining to the safe operation of motor vehicles. Upon receipt of the Police Department's recommendation, the Township Committee shall approve or disapprove the application. The applicant shall be notified of the Township Committee's action within seven days. If approved, a request to Atlantic Electric Company shall be forwarded for installation of the approved streetlight or lights.
