A. Any person, corporation, partnership or other entity
making application to the Township Committee of the Township of Egg
Harbor for the vacation of Township streets, roads and alleyways shall
escrow with the Township Clerk an amount equal to an estimate of the
costs of professional fees to ensure reimbursement to the Township
for the cost of such engineering and legal inspection and review of
the proposal and the preparation of such necessary Township documents
to effect the processing and completion of the application process.
The Township Clerk shall, within five days of an application, notify
the applicant of the amount of money to be escrowed and which will
be required to be paid to the Township Clerk prior to the Township
undertaking any work or review of the application. Prior to the final
passage of the vacation ordinance, payment will be made by the Township
in accordance with the voucher submitted, and the applicant will either
receive reimbursement of the unused funds or notice of such additional
payment necessary for full reimbursement of the Township expenses
prior to completion of the application process. There shall be no
interest paid on the funds escrowed. The rates for engineering and
legal professional fees shall be adopted by resolution of the Township
Committee.
B. An application fee of $100 shall be paid to the Township
Clerk upon submission of a street vacation application. Fees are nonrefundable.
