It is hereby declared and found vital to the
public welfare and safety of the residents of the Village and the
general public that this local law be enacted to regulate and control
traffic, to prevent traffic congestion, to expedite the orderly flow
of traffic and emergency vehicles and to facilitate removal of snow
from Village streets and highways during periods of snow emergency.

A snow emergency shall exist whenever there shall be an accumulation
of snow exceeding 4 1/2 inches (14.29 centimeters) in depth as
measured at the official snow gauge, to be provided and maintained
by the Superintendent of Public Works at such location within the
Village as he, in his discretion, may determine or when declared by
the Mayor or, in his absence, the Deputy Mayor or Superintendent of
Public Works in anticipation of a predicted major snow event.

The presence on any street or highway within the Village of
an accumulation of snow to a depth exceeding 4 1/2 inches (14.29
centimeters) or a declared snow emergency by the Mayor, Deputy Mayor
or Superintendent of Public Works shall be deemed notice to all operators
of motor vehicles stopping, standing or parking such vehicles on such
street or highway that the snow emergency parking regulations set
forth in this article are in effect at such time and place, and it
shall be presumed that such motor vehicle operators have actual notice
of the existence of a snow emergency by reason of such snow accumulation
or declaration.

A snow emergency shall remain in effect for a period of 24 hours
after it commences, unless sooner declared terminated by the Mayor
or, in the event of the absence of the Mayor, the Deputy Mayor or
the Superintendent of Public Works.

The Superintendent of Public Works shall cause to be posted, erected and maintained appropriate signs at street locations clearly visible to all vehicles entering the Village by all major streets, at or near the Village boundary, and upon such streets as shall be designated herein as snow emergency routes, to provide notice of the parking, stopping and standing regulations that shall be in effect during snow emergencies as defined in §
237-55 of this article. The type, number and location of such signs shall be determined by the Superintendent of Public Works.

During a snow emergency, as defined in §
237-55 of this article, the following parking, stopping and standing regulations shall apply:
A. No person shall park a vehicle or permit the same to stand on any
street or highway within the Village during any part of the twenty-four-hour
period commencing at such hour as a snow emergency commences or is
declared and continuing for 24 hours thereafter or until such time
as a declared snow emergency has been declared terminated.

B. The following streets are designated as snow emergency routes. No
person shall park, stop, stand or abandon a vehicle along such snow
emergency routes during a snow emergency:

C. No person shall park a vehicle, but may stop the same temporarily
for the purpose of and while actually engaged in receiving or discharging
passengers, on any street within that part thereof extending 35 feet
distant, as measured along the curbline, from any intersecting street.
D. It shall be unlawful and a violation of this article for a person
to leave a vehicle parked or abandoned or left unattended where the
same constitutes an obstruction to the movement of traffic or at any
place where stopping, standing or parking is prohibited in the Village.
E. At those locations where parking, stopping or standing is prohibited and signs giving notice of such prohibition are posted, such prohibition shall continue in effect during periods of snow emergency, notwithstanding the provisions of Subsections
A,
B and
C of this section. All other parking, stopping or standing regulations in conflict with the provisions of Subsections
A,
B and
C of this section are suspended and superseded during periods of snow emergency as herein defined.
F. The snow emergency regulations set forth in Subsections
A,
B and
C of this section shall apply only to those streets and highways maintained by the Village, except Railroad Avenue, and shall not apply to streets and highways maintained by the state, county or town governments, including, specifically, but not limited thereto by reason of specification, the following streets and highways: Jericho Turnpike (Route 25), Brush Hollow Road, Maple Avenue, Old County Road, Post Avenue, Union Avenue and Westbury Avenue, unless the removal of snow from said streets becomes the responsibility of the Village by future agreement, in which case the provisions set forth in this article shall apply.
G. The Mayor or, in the absence of the Mayor, the Deputy Mayor or, in the absence of the Mayor and Deputy Mayor, the Superintendent of Public Works shall have the authority to implement such other and different emergency measures as in their discretion, shall be deemed necessary to properly manage such snow emergency, Subsection
A above notwithstanding.

The Superintendent of Public Works is hereby empowered and authorized
to designate certain additional streets and highways within the Village
as snow emergency routes and to cause to be erected and maintained
thereon appropriate signs at reasonable intervals along such snow
emergency routes to provide notice that parking, stopping, standing
or abandonment of vehicles along such snow emergency routes during
a snow emergency is prohibited, and it shall be unlawful for any person
to park, stop, stand or abandon a vehicle on a street so designated
and signed as a snow emergency route during a snow emergency as herein
defined.
The provisions of Article
VIII of this chapter, entitled "Removal and Storage of Vehicles," shall apply to any vehicle that is parked, stopped, standing or abandoned on any street or highway within the Village in violation of this Article
VII. Any person violating this article shall be guilty of a traffic infraction, and every person convicted of a violation thereof shall be liable to be punished by a fine or imprisonment, or both, in accordance with §
237-66 of this chapter.
