The Village Plan Commission is hereby established. The Commission shall
consist of the Village President, who shall be its presiding officer, a Village
Trustee and five Village residents of recognized experience and qualification.
Additionally, the Village President may appoint, with the approval of the
Plan Commission, one person engaged in business in the Village but not a resident
thereof as a nonofficial member of the Commission who may participate in all
discussions of the Commission but who shall be a nonvoting member thereof.
The Village Trustee who is elected to the Plan Commission shall submit
a report of each Plan Commission meeting at the first regularly scheduled
Village Board meeting thereafter.
The powers and duties of the Commission shall be to:
A. Keep a record of its resolutions, transactions, findings
and determinations, which record shall be a public record.
B. Perform such duties as are delegated to the Commission
by any ordinances of the village.
C. Recommend to the Village President or Village Board programs
for public improvements and the financing thereof.
D. Parks and playgrounds.
(1) When requested by the Village Board, the Plan Commission
may delegate to the Recreation and Park Committee jurisdiction to recommend
updates to the master plan for the Village Center for final approval by the
Village Board.
(2) Recommendations to the Village Board with respect to any updating recommendations made pursuant to Subsection
D(1) above shall be reviewed and submitted by the Plan Commission.
E. Advise regarding the planning and protection of trees
and other improvements along highways and on public property.
F. Report on matters referred to it by the Village Board
or other public bodies or officers.
G. Approve any proposed subdivision and inspect and recommend
as to the zoning thereof before acceptance by the Village Board.
H. Recommend to the Village Board with respect to amendment and addition to Chapter
106, Building Construction, and Chapter
335, Zoning.
I. Define the limits of zoning districts upon the request
of the Board of Appeals when a request for interpretation of the Zoning Map
is made due to district boundaries being undeterminable from the Zoning Map.
J. Review and recommend any amendment to the Official Map
of the village.
K. Make and adopt a master plan for the physical development
of the village in accordance with the provisions of § 62.23(2),
Wis. Stats.
L. Review and recommend to the Village Board of Trustees
the adoption and amendment of design guidelines pursuant to § 62.23,
Wis. Stats.
M. In performance of its function, enter upon any land and
make examination thereof.
N. At its discretion, make such recommendations to the Village
Board as it deems advisable.
O. With regard to floodplain zoning under Chapter
335, Zoning:
(1) Review and act upon all proposed amendments to the floodplain
zoning ordinance.
(2) Maintain a complete public record of all proceedings.
(3) Advise the Board of Appeals and the Village Board concerning
floodplain zoning both upon request and upon its own initiative.
Unless it is specified that the appeal of a Plan Commission decision
is to be taken to the Board of Appeals, appeals from any order of the Plan
Commission denying any application presented to it for approval may be taken
up by any person aggrieved thereby to the Village Board. Such appeals shall
be taken within a period of 10 days after the making of such order by filing
with the Village Clerk a notice of appeal specifying the grounds thereof,
together with a filing fee as may from time to time be determined by the Village
Board. The Village Clerk shall forthwith set a date for hearing of such appeal
and prepare an appeal file containing all the papers in such matter. The Board
shall fix a reasonable time for the hearing of the appeal, give public notice
thereof and decide the same within a reasonable time. At the hearing, any
party may appear in person or by an agent or attorney.
