It shall be unlawful for any person or persons,
firm or corporation to own, keep, harbor or permit to run at large
any dog or dogs, male or female, within the Borough of South River
unless such dog or dogs shall be registered and licensed as hereinafter
provided, and unless a collar or harness shall be placed about the
neck or body of such dog or dogs and the metallic tag of registration,
referred to in this article, affixed to such collar or harness.
It shall be unlawful for any person or persons
to remove any registration tag from any dog or dogs registered or
licensed hereunder or to use such tag in any manner other than as
herein provided.

A. License fees:
(1) The license fee for each male or female dog shall be in the sum provided in Chapter
155, Fee, for the purpose of regulation and raising revenue for the cost involved for the collecting of dogs liable to seizure pursuant to the terms of this article, for local prevention and control of rabies and for providing of antirabies treatment of such dogs under the direction of the local Board of Health.
(2) The sum provided in Chapter
155, Fees, shall be charged for a replacement metal tag.
(3) In addition to the annual dog license fee, a sum as provided in Chapter
155, Fees, shall be charged, and the Borough Clerk shall forward such additional fee to the State Department of Health by the 10th day of each month following such issuance of said registration or licensing, pursuant to N.J.S.A. 4:19-15.1 et seq. on forms so provided by the State Health Department.
(4) The sum as provided in Chapter
155, Fees, shall be charged for each dog license for the Pilot Clinic Fund for the State of New Jersey. Said funds shall be remitted in accordance with Subsection C of this §
108-3.
(5) The sum as provided in Chapter
155, Fees, shall be charged for each license issued to a nonspayed and nonneutered dog for the Animal Population Control Program of the State of New Jersey. Said funds shall be permitted in accordance with Subsection C above.
(6) The sum as provided in Chapter
155, Fees, shall be charged for each license issued after the annual renewal period.
B. Exemption. Pursuant to N.J.S.A. 4:19-15.3, persons
owning Seeing Eye dogs, dogs used to assist handicapped persons and
commonly known as "service dogs" and dogs used to assist deaf persons
and commonly known as "hearing ear" dogs shall be exempt from the
paying the license fee but must obtain a license for the dog.
All certificates of registration or licenses
granted hereunder shall be issued for the current year in which such
registration shall take place, and shall expire on December 31 of
such year and be renewed annually.

Whenever the metallic tag of registration has been lost, such tag may be replaced by the Borough Clerk with a new number tag, together with a new certificate of registration, upon the payment of a fee as provided in Chapter
155, Fees, provided that the old certificate of registration is presented at the same time.
The Animal Control Officer shall segregate all
unregistered dogs in the pound from the registered dogs pending redemption.

The Animal Control Officer shall promptly notify the owner or owners of any dog bearing a registration tag of the Borough of South River that such dog has been caught running at large contrary to the provisions of this article and that the said dog will be destroyed if not reclaimed within seven days from the date stated in the notice mailed. Such dog may be reclaimed by the payment of a reclamation fee as provided in Chapter
155, Fees, besides the registration fee of such dog pursuant to the terms of this article. The Animal Control Officer shall immediately submit the registration fee to the Borough Clerk, who shall deliver to the owner or the person claiming such dog a certificate of registry, together with a metallic number tag for same. The Borough Clerk shall report all such fees in his regular report to the Borough Council.
It shall be the duty of each member of the Police
Department of the Borough of South River to assist in carrying out
the provisions of this article.
The Council, when in its opinion the public
safety may require, may issue a proclamation authorizing the destruction
of all dogs, male or female, found running at large without being
properly muzzled with a muzzle about the nose, securely fastened,
or all dogs on leash not being properly muzzled with a muzzle about
the nose, securely fastened; provided that nothing in said proclamation
shall apply to dogs of nonresidents passing through the Borough accompanied
by the owner of such dog or dogs.

Except as provided in N.J.S.A. 4:19-15.19, any person or persons, firm or corporation who shall violate any of the provisions of this article shall, upon conviction thereof, be subject to the penalties provided in Chapter
1, Article
I, General Penalty.
This article is adopted for the purpose of raising
revenue as well as for regulations.
