The Borough Council is hereby authorized to license any person or persons
to keep a billiard saloon at any regular meeting of the Council. Before any
license so granted shall be delivered to the applicant or applicants for the
same, the license fee and costs shall be paid to the Borough Clerk, who shall
pay the same to the Borough Treasurer. All licenses granted hereunder shall
be signed by the Mayor and Clerk. Every license granted under this chapter
shall bear even date with the day when the same is signed by the Mayor and
Clerk, and unless sooner revoked by lawful authority, all licenses granted
under the provisions of this chapter shall expire and be utterly void and
of no effect on the first day of May in each year.
No license to keep a billiard saloon shall be granted unless the applicant
therefor is a citizen of the United States and unless there is presented to
the Borough Council a written application signed by the applicant or applicants,
setting forth the place or premises where they wish to keep their table and
the number and kind of tables which they propose to use. Each application
shall also be signed by at least 10 reputable citizens and freeholders of
the Borough of South River recommending the granting of such license and certifying
that the applicant is of good repute and is in their judgment a proper and
fit person to have such license. There shall be attached to the said application,
and form a part thereof, an oath or affirmation of the applicant, before some
person authorized to administer the same, setting forth that the applicant
is a citizen of the United States and that each and every person who has signed
recommending the granting of a license is a citizen and freeholder of the
Borough of South River; provided, however, that where the application is for
a renewal or continuation of such license, then such application may be signed
by the applicant only and the recommendation of the citizens and freeholders
and the oath relating to the freeholders shall be dispensed with.

The fee for a license to keep a billiard room wherein billiards, pocket billiards, the game called "pool" or any other similar game is played shall be as provided in Chapter
155, Fees.

Every person who may be granted a license hereunder shall close his
billiard saloon on weekdays and Saturdays at 2:00 a.m. and shall remain closed
until 7:00 a.m. of the same day except on Sundays when the billiard saloon
shall close at 2:00 a.m. and remain closed until 12:00 noon on the same day.
The entire interior of such billiard saloon, during all of the prohibited
hours, shall be opened to full view from the public street.
No license shall entitle any licensee to keep a billiard saloon in any
other place than that which is designated in said license, nor shall such
license be assignable or transferable.
Any person or persons granted a license under this chapter shall cause
the license certificate issued to be kept in a conspicuous part of the licensed
place of business.

A. No person or persons licensed under this chapter to keep
a billiard saloon shall suffer or permit any person under the age of 18 years
to frequent or loiter in, upon or about such licensed premises, unless said
person is accompanied by a parent, legal guardian or spouse who has attained
the age of 18 years. This prohibition shall not apply to persons who are bona
fide employees of the licensee, during the hours of their employment.
B. No licensee shall suffer or permit any dice throwing,
crap shooting, gambling or disorderly conduct of any kind whatsoever in, upon
or about such licensed premises.
A true and correct list of all licenses which shall be granted under
this chapter shall be kept by the Borough Clerk in a book to be provided for
that purpose, which book shall at all times be open to the public for inspection.
All complaints of violation of the provisions of this chapter shall
be made before the Judge of the Municipal Court of the Borough of South River,
and the fine or penalty arising under this chapter, as hereinafter prescribed,
may be recovered before such Judge in the manner provided by law, and when
recovered, shall be paid into the Borough treasury.
In addition to the fine or penalties hereinabove mentioned and prescribed
for a violation of the provisions of this chapter, the Borough Council may
revoke the license so issued, if it deems it proper so to do, if, after due
notice to the licensee and an opportunity is given to said licensee to be
heard thereon, the Council is satisfied that the said licensee has offended
against any law of the state applicable to such licensed place or that the
provisions of this chapter or any section or part thereof have been violated.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be punishable as provided in Chapter
1, Article
I, General Penalty.
