The purpose of this chapter is to enable the streets of the
Borough of South River to provide safe, convenient, and comfortable
routes for walking, bicycling, and public transportation that encourage
increased use of these modes of transportation, enable convenient
travel as part of daily activities, improve the public welfare by
addressing a wide array of health and environmental problems, and
meet the needs of all users of the streets, including children, older
adults, and people with disabilities. The contents of this chapter
will address a variety of traffic and parking designations.
A.
The following words and phrases, whenever used in
this chapter, shall have the meanings defined in this section unless
the context clearly requires otherwise.
B.
Whenever any undefined words and phrases are used in this chapter,
the meanings respectively ascribed to them in Subtitle 1 of Title
39 of the Revised Statutes of New Jersey shall be deemed to apply
to such words and phrases used herein.

As set forth in this chapter, the following terms
shall have the meanings indicated:
Design features that contribute to a safe, convenient, or
comfortable travel experience for users, including but not limited
to features such as: sidewalks; shared use paths; bicycle lanes; automobile
lanes; paved shoulders; street trees and landscaping; planting strips;
curbs; accessible curb ramps; bulb-outs; crosswalks; refuge islands;
pedestrian and traffic signals, including countdown and accessible
signals; signage; street furniture; bicycle parking facilities; public
transportation stops and facilities; transit priority signalization;
traffic calming devices, and surface treatments such as street paint,
paving blocks, textured asphalt, and concrete; narrow vehicle lanes;
raised medians; and dedicated transit lanes.

Any right of way, public or private, including arterials,
connectors, alleys, ways, lanes, and roadways by any other designation,
as well as bridges, tunnels, and any other portions of the transportation
network.
The construction, reconstruction, retrofit, maintenance,
alteration, or repair of any street, and includes the planning, design,
approval, and implementation process, except that "street project"
does not include minor routine upkeep such as cleaning, sweeping,
mowing, spot repair, or interim measures on detour routes (and does
not include projects with a total cost of less than $10,000).
Individuals that use streets, including pedestrians, bicyclists,
motor vehicle drivers, public transportation riders and drivers, emergency
vehicles, freight and people of all ages and abilities, including
children, youth, families, older adults, and individuals with disabilities.
A.
The Department
of Transportation, Department of Public Works, and other relevant
departments shall make complete streets practices a routine part of
everyday operations, shall approach every transportation project and
program as an opportunity to improve public and private streets and
the transportation network for all users, and shall work in coordination
with other departments, agencies, and jurisdictions to achieve complete
streets within the Borough.
B.
Every street
project on public streets shall incorporate complete streets infrastructure
sufficient to enable reasonably safe travel along and across the right-of-way
for each category of users; provided, however, that such infrastructure
may be excluded upon written approval by the Borough Administrator
or Borough Engineer where documentation and data indicate that:
(1)
Use
by nonmotorized users is prohibited by law;
(2)
The
cost would be excessively disproportionate to the need or probable
future use over the long term;
(3)
There
is an absence of current or future need; or
(4)
Inclusion
of such infrastructure would be unreasonable or inappropriate in light
of the scope of the project.
C.
As feasible,
the Borough shall incorporate complete streets infrastructure into
existing streets to improve the safety and convenience of users, construct
and enhance the transportation network for each category of users,
and create employment.
D.
If the
safety and convenience of users can be improved within the scope of
pavement resurfacing, restriping, or signalization operations on public
streets, such projects shall implement complete streets infrastructure
to increase safety for users.
E.
The Department
of Transportation, Department of Public Works, and other relevant
departments shall review and either revise or develop proposed revisions
to all appropriate plans, zoning and subdivision codes, laws, procedures,
rules, regulations, guidelines, programs, templates, and design manuals
to integrate, accommodate, and balance the needs of all users in all
street projects on Borough property.
F.
In design
guidelines, the Department of Transportation, Department of Public
Works and other relevant departments shall coordinate templates with
street classifications and revise them to include complete streets
infrastructure, such as sidewalks, street crossings, bicycle lanes,
and planting strips.
The Task Force for Safe Streets shall be responsible for the
following tasks within the Borough of South River:
A.
The Task
Force for Safe Streets shall develop policy for collecting data measuring
how well the streets of the Borough of South River are serving each
category of users.
B.
The Task
Force for Safe Streets shall consider developing performance standards
with measurable benchmarks reflecting the ability of users to travel
in safety and comfort.
C.
When appropriate,
the Task Force for Safe Streets shall establish procedures to allow
full public participation in policy decisions and transparency in
individual determinations concerning the design and use of streets.
A.
Unless another penalty is expressly provided by New
Jersey statute, every person convicted of a violation of a provision
of this chapter or any supplement thereto shall be liable to a penalty
of not more than $50.
B.
Fines.
(1)
The following listed violations may be paid through
the Violations Bureau of the South River Municipal Court without the
necessity of a Court appearance, and the following fines shall be
imposed:

(2)
In addition to the foregoing fines, the Municipal
Court, in its discretion, may impose Court costs consistent with those
permissible in Municipal Court, as well as any surcharges as set forth
by state statute.
If any part or parts of this chapter are held
to be invalid for any reason, such decision shall not affect the validity
of the remaining portions of this chapter.
