Any person who shall violate any of the provisions of this chapter shall, upon conviction, be subject to the penalties in Chapter
1, Article
I, General Penalty, in the discretion of the Judge of the Municipal Court. Each day that a violation continues shall be considered and shall constitute a separate offense.
This chapter shall not apply to the removal of soil for building excavation
or for a private sewage disposal system or for landscaping, nor shall this
chapter apply to or be construed to include plowing, spading, cultivating,
harrowing or disking of soil or any operation usually and ordinarily associated
with the tilling of the soil for agricultural or horticultural purposes. This
chapter shall not be construed to include any operations for the purpose of
soil and water conservation as defined or prescribed by the Soil Conservation
Service of the United States Department of Agriculture. Nothing contained
in this chapter shall conflict with the present or any future Zoning Ordinance
of the Borough of South River, and in the case of such a conflict, said Zoning
Ordinance shall prevail. Anything herein to the contrary notwithstanding,
no permits shall be required in connection with the removal of excess soil
resulting from the construction or alteration of a building, structure or
off-street loading or parking areas on such premises and new streets, roadways
or driveways and excavation or grading incidental thereto.
