GENERAL REFERENCES
Fire prevention and building construction — See Ch. 54.
Upon receipt of notice to the Town Board that any building or structure within a business, industrial or residential section of the Town is dangerous or unsafe to the public, the Town Board shall appoint an official of said Town, to be designated by the Town Board, to make an inspection of such building or structure and to report in writing thereon to said Town Board.
A. 
Upon receipt of said report, the Town Board shall examine the same, and if it appears to the Town Board that said building or structure may be dangerous or unsafe to the public, the Town Board shall cause written notice to be served on the owner thereof or some one of the owner's executors, legal representatives, agents, lessees or any other person having a vested or contingent interest in the same, either personally or by certified mail, addressed to the last known address, if any, of the owner or some one of the owner's executors, legal representatives, agents, lessees or other persons having a vested or contingent interest in the same, as shown by the records of the Receiver of Taxes or in the office of the County Clerk.

B. 
The notice shall contain the following:
(1) 
A description of the premises.
(2) 
A statement of the particulars in which the building is unsafe or dangerous.
(3) 
An order outlining the manner in which the building is to be made safe and secure, or demolished and all remaining debris removed from the property.

(4) 
A statement that the securing or demolition and removal of all remaining debris of such building shall commence within three days of the service of the notice and shall be completed within 60 days thereafter, unless for good cause shown, such time shall be extended.

(5) 
A date, time and place for a hearing before the Town Board in relation to such dangerous or unsafe building, which hearing shall be scheduled not less than five business days from the date of service of the notice.
(6) 
A statement that in the event of neglect or refusal to comply with the order to secure or demolish the building and remove all remaining debris from the property, the Town Board is authorized to provide for its demolition and to remove all remaining debris from the property, to assess all expenses thereof against the land on which it is located and to institute a special proceeding to collect the costs of demolition, including legal expenses.

C. 
A copy of the notice, served as provided herein, shall be filed in the office of the County Clerk of the County of Saratoga.
In the event of the refusal or neglect of the person so notified to comply with said order of the Town Board and after the hearing, the Town Board shall provide for the demolition and removal of such building or structure either by Town employees or by contract.

Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to a fine not to exceed $250 or to imprisonment for a term not to exceed 15 days, or both.
