As used in and for the purpose of this article,
certain words and phrases shall have the meanings herein indicated:
RESIDENT
Anyone residing in the City of Ventnor City for one or more
days or carrying on the business of renting bicycles, unicycles or
adult tricycle within the City.

A. All bicycles, unicycles or adult tricycles owned by
residents of the City of Ventnor City and operated on the highways
and Boardwalk of the City shall be inspected by and registered with
the Department of Public Safety. Registration shall take place at
the same time the bicycle is inspected, which inspection shall take
place at the Ventnor City fire house on Winchester Avenue in the City
of Ventnor City, New Jersey, on Fridays at the prescribed times as
designated by the Commissioner of Public Safety. Such initial registration
and inspection will be considered permanent to the effect that only
in the event of a change in ownership shall a new registration and
inspection be required.
B. Registration certificates shall be maintained on file
with the Police Department. Upon registering and inspecting the bicycle,
unicycle or adult tricycle, a registration decal and inspection sticker
to be placed on the bicycle, unicycle or adult tricycle will be issued
by the inspecting personnel, shall show the date of registration and
inspection only and shall be maintained on the bicycle, unicycle or
adult tricycle at all times.
No person shall operate a bicycle, unicycle
or adult tricycle unless it is equipped with a bell or other device
capable of giving a signal audible for a distance of at least 100
feet, except that a bicycle shall not be equipped with nor shall any
person use upon a bicycle, unicycle or adult tricycle any siren or
whistle.
No person shall operate a bicycle, unicycle
or adult tricycle at nighttime unless it is equipped with a lamp on
the front which shall emit a white light visible from a distance of
at least 500 feet to the front and a lamp on the rear which shall
emit a red light visible from a distance of at least 500 feet to the
rear. In addition to the red lamp, a red reflector may be mounted
on the rear which shall be visible from all distances from 50 feet
to 300 feet to the rear when directly in front of lawful upper beams
of headlamps on a motor vehicle.
No person shall operate a bicycle, unicycle
or adult tricycle unless it is equipped with a brake which will enable
the operator to make the brake wheel skid on dry, level and clean
pavement.
A person propelling or riding on a bicycle,
unicycle or adult tricycle shall not ride other than upon or astride
a permanent and regular seat attached thereto, nor shall he/she ride
with his/her feet removed from the pedals or with both hands removed
from the handlebars. No bicycle, unicycle or adult tricycle shall
be used to carry more persons at one time than the number for which
it is designed and equipped.
No person riding upon any bicycle, unicycle
or adult tricycle shall attach the same or himself/herself to any
vehicle upon a roadway, and no operator of any such vehicle shall
knowingly allow any person riding upon any bicycle, unicycle or adult
tricycle to attach the same or himself/herself to any such vehicle.
It shall be unlawful to operate a bicycle, unicycle
or adult tricycle on any public highway, the Boardwalk or the approaches
thereto or on any other public right-of-way or public grounds in a
careless manner or without due caution and circumspection or in a
manner so as to endanger or be likely to endanger any person or property.

A. It shall be unlawful to operate a bicycle, unicycle
or adult bicycle upon the boardwalk or the approaches thereto, except
in the designated bicycle path. The aforementioned vehicles shall
be permitted to operate in the designated bicycle path during daylight
hours, except from July 1 to Labor Day on Saturday and Sunday such
vehicles shall only be permitted to operate from 6:00 a.m. to 12:00
noon.

B. It shall be lawful to operate a bicycle, unicycle
or adult tricycle upon any sidewalk.
Every person operating a bicycle, unicycle or
adult tricycle upon a roadway shall be granted all of the rights and
shall be subject to all of the duties applicable to a driver of a
vehicle pursuant to N.J.S.A. 39:4-1 et seq., except as to those provisions
thereof which by their nature can have no application. Regulations
applicable to bicycles, unicycles or adult tricycles shall apply whenever
a bicycle, unicycle or adult tricycle is operated upon the highway,
Boardwalk or the approaches thereto.
Every person operating a bicycle, unicycle or
adult tricycle upon a roadway shall ride as near to the right side
of the roadway as practicable, exercising due care when passing a
standing vehicle or a vehicle proceeding in the same direction. Persons
riding bicycles, unicycles or adult tricycles upon a roadway shall
ride in single file except on paths or parts of roadways set aside
for the exclusive use of bicycles, unicycles or adult tricycles. Whenever
a usable path for the bicycles, unicycles or adult tricycles has been
provided adjacent to a roadway, riders shall use such path and shall
not use the roadway.

Any person violating any of the provisions of
this article shall, upon conviction thereof, be punished by a fine
not to exceed $25 and/or by confiscation of the bicycle, unicycle
or adult tricycle as follows:
A. For the first offense: up to 10 days.
B. For the second offense: up to 20 days.
C. For the third and subsequent offenses: up to 30 days.
D. In addition to or as a substitute for the previously
mentioned fine, the imposition of community service shall be authorized
as an additional penalty, which community service shall not exceed
90 days.

The total fee for registering and inspecting bicycles will be in the amount set forth in Chapter
114, Fee Schedule. The money collected by the City for registrations shall be placed in a special fund which will be used to cover the expenses of the program.

A. It shall be lawful for any person to be upon roller skates upon the Boardwalk or the approaches thereto in the City of Ventnor City as long as said such person or persons wearing said skates are in the designated bicycle path area. They shall be permitted to operate in the designated bicycle path area only during the hours specified under §
75-9A of this Code.

B. It shall be unlawful for any person to operate or
use in any manner a skateboard on the Boardwalk, the Boardwalk ramps
or on any City-owned park located on the beach blocks or at the beach
front in Ventnor City.

Any person violating any of the provisions of this article shall, upon conviction thereof, be subject to the penalty provisions of Chapter
1, Article
II, General Penalty.
