Any subdivider or purported subdivider who shall
take any action with respect to a subdivision in violation of any
provision of these subdivision regulations, or who shall take any
action with respect to a subdivision without first obtaining the approvals
required by these subdivision regulations, or who shall violate any
term, condition or modification ordered pursuant to any provision
of these subdivision regulations, or who shall omit, neglect or refuse
to do any act required by these subdivision regulations, shall be
guilty of an offense and subject to a fine of not more than $350 or
imprisonment for a period not to exceed six months, or both, and in
addition, may be ordered to pay all costs and expenses involved in
the case. Every such subdivider shall be deemed guilty of a separate
offense for each week that such violation, omission, neglect or refusal
shall continue.
In case any building or structure is erected,
constructed, reconstructed, altered, converted or maintained, or any
building, structure or land is used, or any land is divided into lots,
blocks or sites in violation of these subdivision regulations, the
Town Board, in addition to other remedies, may institute any appropriate
action or proceeding to prevent such unlawful erection, construction,
reconstruction, alteration, conversion, maintenance, use or division
of land, to restrain, correct or abate such violation, to prevent
the occupancy of said building, structure or land or to prevent any
illegal act, conduct, business or use in or about such premises.
