For the purpose of these regulations, certain words and terms used herein are defined as follows:
BUILDING LOT
Any lot upon which a principal residential building can be constructed in conformance with the requirements of the Zoning Ordinance.[1]
CODE ENFORCEMENT OFFICER
The Code Enforcement Officer of the Village of Fishkill, New York.

COMPREHENSIVE PLAN or DEVELOPMENT PLAN
The comprehensive plan for development of the Village of Fishkill, New York, prepared and adopted by the Planning Board and/or Village Board of Trustees pursuant to § 7-722 of the Village Law, and includes any part of such plan separately adopted and any amendment to such plan or parts thereof.

CONSTRUCTION PLAN
The maps or drawings described in § 139-86 accompanying a subdivision plat and showing the specific location and design of improvements to be installed in the subdivision in accordance with the requirements of the Planning Board as a condition to the approval of said plat.
DEVELOPMENT PLAN
The comprehensive plan for development of the Village of Fishkill, New York, prepared and adopted by the Planning Board pursuant to § 7-722 of the Village Law, and includes any part of such plan separately adopted and any amendment to such plan or parts thereof.
EASEMENT
Authorization by a property owner for the use by another, and for a specified purpose, of any designated part of his property.
ENGINEER, VILLAGE'S
Such licensed professional engineer as is employed by the village on a regular or consulting basis.
FINAL PLAT
The final drawing or drawings provided for in Article 7, §§ 7-728 and 7-730, of the Village Law, Chapter 64 of the Consolidated Laws, and described in §§ 139-17 through 139-25 and 139-85, submitted to the Planning Board for final approval and which, if approved, shall be submitted to the County Clerk for recording.

OFFICIAL MAP
The map which may be established by the Board of Trustees under § 7-724 of the Village Law, showing the streets, highways and parks theretofore laid out, adopted and established by law, and any amendments or additions thereto resulting from the approval of subdivision plats by the Planning Board and the subsequent filing of such approved plats.
OFFICIAL SUBMITTAL DATE
The date on which a subdivision plat application is considered to be officially submitted to the Planning Board, pursuant to § 7-728 of the Village Law, and which is hereby defined as the date of the next regular meeting of the Planning Board following completion of the application procedure outlined in § 139-12 for a preliminary plat and in §§ 139-17 and 139-18 for a final plat.

PERFORMANCE BOND
A bond, as required by § 7-730 of the Village Law, to assure the full and satisfactory completion of all required subdivision improvements as specified in the Planning Board resolution of approval, such bond to run for a term fixed by the Planning Board and with surety, form, sufficiency and manner of execution approved by the Village Attorney.

PLANNING BOARD
The Planning Board of the Village of Fishkill, New York.
PRELIMINARY PLAT
The drawing or drawings and related information described in §§ 139-12 through 139-16 and 139-84 of these regulations, showing the proposed layout of the proposed subdivision submitted to the Planning Board for review prior to preparation and submission of a subdivision plat with an application for its approval by the Planning Board.
RESUBDIVISION
Any change of existing property lines or of property lines shown on a plat approved by the Planning Board and filed in the office of the County Clerk.
STREET
Includes a way which is an existing state, county, town or village highway, or a way shown upon a subdivision plat approved by the Village Planning Board as provided by law, or on a plat duly filed and recorded in the office of the County Clerk.
STREET, BUSINESS OR INDUSTRIAL
A street which serves or is designed to serve as an access to abutting business or industrial properties.
STREET, COLLECTOR
A street which serves or is designed to carry traffic from local residential streets to the system of major streets.
STREET, DEAD-END
A street or a portion of a street with only one vehicular traffic outlet.
STREET, LOCAL
A street intended to serve primarily as an access to abutting residential properties.
STREET, MAJOR
A street which is used primarily as a route for traffic between communities or large areas and is designated as such on the Village Development Plan.
STREET PAVEMENT
The wearing or exposed surface of the roadway right-of-way designed to be used by vehicular traffic.
STREET WIDTH
The distance between property lines, measured at right angles to the center line of the street.
SUBDIVIDER
Any person, firm, corporation, partnership or association who shall lay out, for the purpose of sale or development, any subdivision or part thereof as defined herein.
SUBDIVISION
The division of any parcel of land into two or more lots, plots, sites or other divisions of land for the purpose, whether immediate or future, of transfer of ownership or building development with or without the creation of new streets or highways, and shall include resubdivision. In changing property lot lines where existing lots or parcels are divided in such a manner as not to involve the creation of a new parcel or lot and to not decrease the area or dimensions of any existing lot or parcel or of any building setback below the zoning requirement, it shall not be considered a land "subdivision" within the meaning of these regulations.
VILLAGE BOARD
The Board of Trustees of the Village of Fishkill, New York.
VILLAGE STANDARDS AND SPECIFICATIONS
Standards and specifications approved by the village for the construction of streets and related improvements.[2]
ZONING ORDINANCE
The officially adopted Zoning Ordinance of the Village of Fishkill, New York, together with any and all amendments thereto.[3]
