This Charter shall be known as the "1923 Revised
Charter of the City of Jamestown."
The City of Jamestown is bounded and described
as follows:
A.Â
All that part of the first and second townships of
the 11th range of townships of the Holland Land Company's survey,
and according to such survey bounded as follows: Beginning at the
southwest corner of Lot 48 in the first township; running thence northerly
along the west line of Lot 48 to the north line of the first township;
thence westerly along the township line to the southwest corner of
Lot 41 in the second township; thence northerly along the west line
of Lots 41 and 42, to the northerly bounds of the lands of the Erie
Railroad Company; thence westerly along the northerly bounds of the
lands of said railroad company 1,403 feet to an iron stake; thence
north 1° and 10 minutes east to the center of the outlet of Chautauqua
Lake; thence easterly along the center line of said outlet to a point
due south of the northwest corner of Lot 35; thence north to the northwest
corner of said Lot 35; thence easterly along the north line of Lot
35, Lot 27 and the east 1/3 of Lot 26; thence to the westerly bounds
of Curtis Street; thence northerly along said westerly bounds of Curtis
Street about 2,000 feet to the angle therein; thence easterly at right
angles with the aforesaid west bounds of Curtis Street 25 feet to
the center thereof; thence northerly along the westerly bounds of
Lot 19 to the northwest corner thereof; thence easterly along the
northerly bounds of said Lot 19, 750 feet to an iron stake, distant
589 35/100 feet westerly from the northeast corner of the west 1/3
of said Lot 19 (measured along the north line of said lot); thence
southerly parallel to and 750 feet easterly from the westerly line
of Lot 19 to a point in the present north boundary line of the City;
thence easterly in direct continuation of the northerly line of Lots
35, 27 and 26 extended to the east line of Lot 19; thence southerly
along the east line of Lot 19 to the outlet of Chautauqua Lake; thence
across said outlet to the northeast corner of Lot 18; thence southerly
along the east line of Lots 18 and 17 to the north line of the first
township; thence east along the township line to the northeast corner
of Lot 24 in the first township; thence southerly along the east line
of Lot 24 to the southeast corner thereof; thence westerly along the
south line of Lots 24, 32, 40 and 48 to the place of beginning.

of Ellicott, County of Chautauqua and State of New York and being
a part of Lot 56, Town 1 and Range 11 and also Lot 49, Town 2 and
Range 11 of the Holland Land Company's Survey and being further bounded
and described as follows: Beginning at a set rebar w/cap on the easterly
bounds of said Lot 56, old City boundary, at its intersection with
the northerly bounds of improved Baker Street; thence S 57º-13'-36"
W, along said highway boundary, a distance of 283.31 feet to an existing
iron pipe; thence N 15º-04'-27" W a distance of 404.32 feet to
an existing iron pipe; thence S 70º-34'-40" W a distance of 95.44
feet to an existing iron pipe; thence N 15º-18'-19" W a distance
of 1650.50 feet to an existing iron pin; thence S 74º-40'-19"
W a distance of 811.00 feet to an existing rebar w/cap; thence N 00º-27'-41"
W a distance of 77.18 feet to an existing iron pipe; thence N 02º-59'-08"
W a distance of 871.47 feet to an existing iron pipe on the northerly
bounds of said Lot 56; thence S 89º-50'-58" W, along said lot
and town line, a distance of 438.51 feet to an existing rebar w/cap;
thence N 00º-54'-47" W a distance of 120.00 feet to an existing
rebar w/cap; thence N 89º-50'-58" E a distance of 121.49 feet
to an existing iron pipe; thence N 00º-24'-53" W a distance of
260.43 feet to an existing rebar at the southwesterly corner of Homestead
Boulevard; thence N 89º-35'-07" E a distance of 100.00 feet to
an existing iron pipe; thence N 00º-24'-53" W a distance of 125.00
feet to a point on the center line of Glenwood Avenue, passing through
an existing iron pipe 25.00 feet southerly of the last described point;
thence N 89º-35'-07" E, along the center line of Glenwood Avenue,
a distance of 1131.18 feet to a set rebar w/cap on the easterly bounds
of said Lot 49, old City boundary; thence S 00º-21'-05" W, along
said lot line, a distance of 511.11 feet to an existing iron pipe
at the southeasterly corner thereof; thence S 89º-32'-31" E,
along the northerly bounds of said Lot 56 which line is also a town
line, old City boundary and center line of Newland Avenue, a distance
of 596.04 feet to the northeasterly corner of said Lot 56; thence
S 04º-24'-30" E, along said lot line and old City boundary and
passing through an existing iron pipe 25.09 feet southerly of the
last described point, a distance of 2535.47 feet to the point and
place of beginning. Containing 64.61 +/- acres of land according to
a boundary survey prepared by Steven R. Gustafson, P.L.S. dated November,
1992.
The citizens of this state who may from time
to time reside within the territorial limits of the City of Jamestown
are hereby created a municipal corporation in perpetuity to be known
as the City of Jamestown. The City may take and hold in trust real
or personal property for any public purpose, upon such terms as may
be prescribed by the grantor or donor, and may provide for the execution
of such trusts. The City may sue or be sued, prosecute and defend
in any court of law or equity.
All property, real and personal, rights, powers,
privileges and contracts at the time of the passage of this Charter
possessed, owned, occupied, exercised or enjoyed by, as well as all
the duties, contracts, obligations and liabilities imposed upon the
City of Jamestown shall remain in and are hereby transferred to, vested
in and imposed upon said City of Jamestown. All divisions of said
City into road, fire and other districts, highways, streets and alleys
shall remain, be and continue such divisions, highways, streets and
alleys in said City of Jamestown. All local laws, ordinances, rules
and regulations of the City Council of said City in force at the time
of the passage of this Charter shall be and remain valid and effectual
as the local laws, ordinances, rules and regulations of said City
and of its City Council until repealed, modified or changed; subject,
however, to the provisions of this Charter. Said City Council is hereby
authorized and empowered in the name, for and in behalf of the City
of Jamestown, to enforce all such contracts, local laws, ordinances,
rules and regulations, including the collection of debts and demands,
the imposition and collection of fines and penalties, and the prosecution
and defense of all suits, and to do, take and perform all other acts
and proceedings that may be or become necessary or proper to carry
out and enforce said contracts, local laws, ordinances, rules and
regulations with the same force and to the full extent as might have
been done if this Charter had not been passed. The rights and privileges
of all persons or parties that may have arisen or accrued under, pursuant
to or by reason thereof shall remain and be the same under this Charter
as they would have been had this Charter not been passed. All rights
and liabilities of said City existing at the time of the passage of
this Charter shall be in no wise affected or changed hereby.
