A. 
No individual, corporation or firm shall install, alter, relocate, replace, connect to, or be connected to any heating equipment in the City of Amsterdam without first obtaining a heating permit from the Plumbing Inspector.
B. 
Application for a heating permit shall be made to the Plumbing Inspector on forms provided by his or her office. The applicant may be required to submit a heat load calculation, schematic, manufacturer's specifications and/or any other required information necessary to establish compliance of the proposed work with the Uniform Code and applicable reference standards as required by the Plumbing Inspector.
C. 
Application shall be made by the owner, lease architect, engineer or contractor employed in connection with the proposed work.
D. 
Plans and specifications shall bear the signature of the person responsible for the design and drawings.
E. 
Where the State Education Law requires the seal of the registered architect or licensed professional engineer, the Plumbing Inspector shall require such seal on the drawings and specifications before they are submitted for approval.
F. 
Where the applicant requests approval of plans and specifications which comes under the jurisdiction of the State Labor Department, these plans must first be filed and approved by the State Labor Department before they can be received for consideration by the Plumbing Inspector.
G. 
Amendments or revisions to plans and specifications may be made if such amendments are filed prior to the commencement of the work subject to the approval of the Plumbing Inspector.
H. 
Heating permits shall be required for work, which must conform to the Uniform Code, applicable reference standards, and manufacturer's installation instructions. The Plumbing Inspector charged with or accountable for administration and enforcement of the Uniform Code may exempt from the requirement for a heating permit the categories of work listed below. An exemption from the requirement to obtain a permit shall not be deemed an authorization for work to be performed in violation of the Uniform Code. The following categories of work may be excluded from the requirement for a heating permit:
(1) 
Listed residential cooking stoves and portable healing or cooling cord- and plug-connected appliances;
(2) 
Repairs of any equipment, provided the replacement does not alter the equipment's listing or render it inconsistent with the equipment's original manufacturer's specifications.
A. 
Upon completion of the appropriate application form and submittal of the necessary specifications, the Plumbing Inspector shall examine or cause to be examined all plans, specifications, permits and other documents filed therewith. He or she shall approve or disapprove the application(s) within a reasonable time. Upon approval of the application and receipt of the fees thereof, he or she shall issue a heating permit to the applicant upon the form prescribed by the City and he or she shall affix his or her signature or cause his or her signature to be affixed thereto.
B. 
Upon approval of the application, plans and specifications shall be endorsed with the words: "Approved, Plumbing Inspector, Amsterdam, New York." Plans and specifications shall be retained in the files of the Plumbing Inspector and any other set shall be returned to the applicant, together with the heating permit placard, which shall be visibly posted at the work site. These shall be kept at the work site for inspection by the Plumbing Inspector and/or his or her duly authorized representative at all reasonable times.
C. 
If the application, together with the plans and specifications and other required documents filed does not conform to all requirements of the applicable Uniform Code, applicable reference standards, and manufacturer's installation instructions, the Plumbing Inspector shall disapprove the same and shall return said plans and specifications to the applicant. Upon request of the applicant within five business days, the Plumbing Inspector shall cause such refusal, together with the reasons for the same, to be transmitted to the applicant in writing.
A heating permit shall be valid to authorize the beginning of work in accordance with the application and the approved plans and/or specifications on which it is based for a period of 12 months after the date of its issuance.
The issuance of a heating permit constitutes authority to the applicant to proceed with the work. All work must be in accordance with the approved plans and specifications, all applicable building laws, codes, regulations, and Zoning Ordinance.[1] Any change to be made to a system shall first be made in writing to and approved by the Plumbing Inspector. Permits issued for work must be closed out with a certificate of compliance.

A. 
Permitted work shall be required to remain accessible and exposed until inspected and accepted by the Plumbing Inspector and/or duly authorized representative. Permit holders are required to notify the Plumbing Inspector at least 48 hours prior to when ready for inspection as set forth in this article.
B. 
Provisions shall be made for inspection of the following elements of the construction process, where applicable:
(1) 
Work site prior to the issuance of a permit;
(2) 
Building systems, including underground and rough-in;
(3) 
Fire-resistant penetrations;
(4) 
Solid-fuel-burning heating appliances, chimneys, flues or gas vents;
(5) 
Energy Code compliance; and
(6) 
A final inspection after all work authorized by the heating permit has been completed.
C. 
After inspection, the work or a portion thereof shall be noted as satisfactory as completed by the Plumbing Inspector and/or his or her duly authorized representative, or the permit holder shall be notified where the work fails to comply with the Uniform Code. Work not in compliance shall be required to remain exposed until it has been brought into compliance with the Code, reinspected and verified by the Plumbing Inspector to meeting minimum requirements as completed.
A. 
An approved permit for construction shall not be issued to the applicant until a fee based on the following has been paid to the City of Amsterdam:
(1) 
Permit fees will be set by resolution titled "Schedule of Fees," and set by the Common Council, and forwarded to the Division.
B. 
Permits required for building, plumbing, electrical and sprinklers or other separate contracts included or not included in the architect's or general contractor's estimate shall be paid for by each of the various separate contractors doing work in accordance with the Schedule of Fees set forth by resolution by the Common Council.
C. 
No fee will be required for permits issued for work performed on behalf of the City of Amsterdam on municipally owned buildings, structures or other property.
A. 
The Plumbing Inspector may revoke a heating permit issued by him or her in the following instances:
(1) 
If he or she finds that the permit(s) have been issued in error and are not in accordance with applicable laws.
(2) 
If he or she finds a false statement or misrepresentation as to a material fact in the application, plans or specifications on which the heating permit was based.
(3) 
If he or she finds work is being performed without first obtaining a required permit.
(4) 
Work performed or to be performed is determined to be contrary to provisions of the Uniform Code and applicable reference standards, application submitted, or manufacturer's installation instructions.
(5) 
Where the person to whom the heating permit is issued fails or refuses to comply with a stop-work order issued by the Plumbing Inspector and/or other duly authorized employee.
B. 
Wherever the Plumbing Inspector or the duly authorized inspector has reasonable grounds to believe that the work on any building, structure, or grounds is being executed in violation of the provisions of any of the applicable building laws, ordinances, zoning regulations, or are not in conformity with the plans and specifications on which the permit was based or the work is being done in an unsafe and dangerous manner, he or she shall notify the owner of the property and/or building, owner's agent, or the person performing the work to suspend all operations. All installation activities shall cease until the stop-work order has been rescinded by the Plumbing Inspector. The Plumbing Inspector shall follow up with the reason for the issuance and the conditions of which must be satisfied before work will be permitted to resume. Work commenced prior to the issuance of a stop-work order shall not resume until the owner and/or his representative is notified in writing by the Plumbing Inspector that the stop-work order has been rescinded.
A. 
Whenever the Plumbing Inspector rejects any plan or specifications of any building or structure, or where he or she claims that plans violate part or parts of the Uniform Code, Zoning Ordinance, other building regulations, or where he or she disallows a permit because in his or her interpretation of this chapter a violation will result, then the owner or applicant may appeal as follows:
(1) 
An appeal involving a question under the Uniform Code shall be taken within six business days from the date of the decision of the Plumbing Inspector to the New York State Building Code Board of Review. A copy of such notice of appeal shall be filed with the Plumbing Inspector at that same time.
B. 
If the decision of the reviewing Board is favorable to the applicant, the Plumbing Inspector shall issue a heating permit in accordance therewith. If the decision of the reviewing board is not favorable to the applicant, compliance shall be met forthwith.
A. 
Upon the satisfactory completion and final inspection and test of the heating and/or cooling system and all connections, a certificate of compliance shall be issued by the Plumbing Inspector.
B. 
No system hereinafter replaced, altered, extended, enlarged, converted, or altered in any manner requiring the issuance of a heating permit shall be of such a nature as to constitute before its completion a hazardous condition which shall endanger the lives or persons of the occupants shall be used until the Plumbing Inspector has issued a certificate of compliance.
C. 
It is the duty of the Plumbing Inspector to make or direct to have made by his duly authorized inspector an inspection of the work in question at its completion to satisfy that the work has been done in a safe manner in conformity with the plans and specifications filed when the heating permit was issued and in accordance with this chapter.
