As used in this chapter, the following terms shall have the meanings indicated:
HOMEOWNERS' PERMIT
A permit for the unlicensed individual owner of a one- or two-family residential property, and/or accessory structure, which he or she owns and is personally performing the installation as stated on the affidavit for homeowners'residential plumbing permit provided by the City Engineer's office and approved at the discretion of the Plumbing Inspector for the work listed on the plumbing permit. This permit does not allow an individual, employee, or workmen or a corporation/association/trust which owns property to perform work.

MASTER PLUMBER
A person approved by the Plumbing Board of Examiners to be engaged in, or holding themselves out to the general public as being in the business of contracting to install, extend, or alter plumbing for the utilization of water and sewer systems, liquid or gas piping systems, and fuel storage tanks.
PLUMBING INSPECTOR
The individual holding a valid Master Plumber's license from the City of Amsterdam, appointed by the Supervisor of Code Enforcement, who shall serve as the Plumbing Inspector for the City of Amsterdam.

PLUMBING PERMIT
The permit as required herein and issued by the City of Amsterdam Plumbing Inspector for the installation, repair, or alterations of plumbing fixtures and/or systems.
A. 
No individual, corporation, or firm shall install, alter, add to, repair, relocate, replace, maintain, connect to, or to be connected to any plumbing system, sewer system, or gas piping, including pipes, lines, or any parts thereof, in the City of Amsterdam, without first obtaining a plumbing permit from the Plumbing Inspector. This shall include water heaters, hot water supply boilers, and any storage tanks.
B. 
Application for a plumbing permit shall be made to the Plumbing Inspector on forms provided by the City Engineer's office. The applicant may be required to submit a schematic, layout, plans, specifications, and any/all other required information necessary to establish compliance of the proposed installation with the Uniform Code, applicable reference standards, local ordinances, and local conditions.

C. 
Application shall be made by the owner, architect or engineer, or master plumber employed in connection with the proposed work.
D. 
Plans and specifications shall bear the signature of the person responsible for the design and drawings.
E. 
Where the State Education Law requires the seal of the registered architect or licensed professional engineer, the Plumbing Inspector shall require such seal on the drawings and specifications before they are submitted for approval.
F. 
Where the applicant requests approval of plans and specifications which comes under the jurisdiction of the State Labor Department, these plans must first be filed and approved by the State Labor Department before they can be received for consideration by the Plumbing Inspector.
G. 
Amendments or revisions to plans and specifications may be made if such amendments are filed and approved prior to the completion of the work subject to the approval of the Plumbing Inspector.
H. 
Permits may be issued to an individual owner not holding a master plumber's license only for one- and two-family residential properties, and/or their accessory structures, which he or she owns and is personally performing the proposed work listed on the plumbing permit submitted upon execution of an affidavit for homeowners' residential plumbing permit as provided by the City Engineer's office and approved at the discretion of the Plumbing Inspector and/or duly authorized inspector.

An exemption from the requirement to obtain a permit shall not be deemed an authorization for work to be performed in violation of the Uniform Code. The following categories of work shall be excluded from the requirement for a plumbing permit:
A. 
Installation of listed portable plumbing equipment and/or appliances;
B. 
Repair of any equipment, provided the replacement does not alter the equipment's listing or render it inconsistent with the manufacturer's original specifications;
C. 
Water heaters.
A. 
Upon submittal of the appropriate completed application form with the necessary and required information, the Plumbing Inspector shall examine or cause to be examined all plans, specifications, permits and other documents filed therewith. The inspector shall approve or disapprove the application(s) within a reasonable time. Upon approval of the application and receipt of the fees thereof, he or she shall issue a plumbing permit to the applicant upon the form prescribed by the City and shall affix his or her signature or cause their signature to be affixed thereto.
B. 
Upon approval of the application, plans and specifications shall be endorsed with the words: "Approved, Plumbing Inspector, Amsterdam, New York." Plans and specifications shall be retained in the files of the Division, any other set shall be returned to the applicant, together with the plumbing permit placard, which must be posted conspicuously at the vicinity of the proposed work. These shall be kept at the work site open to inspection by the Plumbing Inspector and/or duly authorized representative at all reasonable times.
C. 
If the application, together with the plans, specifications, and other required documents filed does not conform to all requirements of the applicable Plumbing Code and reference standards, the Plumbing Inspector shall disapprove the same, notify the duly authorized inspector, if needed, and shall return said plans and specifications to the applicant. Upon request of the applicant within five calendar days, the Plumbing Inspector shall cause such refusal together with the reasons for the same to be furnished to the applicant in writing.
Any plumbing permit shall be valid to authorize the beginning of work in accordance with the application of the approved plans and specifications on which it is based for a period of 12 months from the date of its issuance.
The issuance of a plumbing permit constitutes authority to the applicant to proceed with the work, but only in accordance with the approved plans and specifications in accordance with the Uniform Code and applicable reference standards, zoning, and limiting local conditions. Any change to be made to the approved installation shall first be made in writing to the Plumbing Inspector and approved by the Plumbing Inspector.
A. 
Permitted work shall be required to remain accessible and exposed until inspected and accepted by the Plumbing Inspector and/or duly authorized inspector. Permit holders are required to notify the Plumbing Inspector at least 48 hours prior to when the work is ready for inspection as set forth in this article.
B. 
Provisions shall be made for inspection of the following elements of construction process, where applicable:
(1) 
Work site prior to the issuance of a permit;
(2) 
Rough-in, and all underground work before any covering and/or backfilling;
(3) 
All sewer and plumbing systems, any fuel piping, bulk fuel storage tanks, including underground and aboveground and any lines thereof;
(4) 
Fire-resistant penetrations and a final inspection after all work authorized by the plumbing permit has been completed.
C. 
After inspection, the work or a portion thereof shall be noted as satisfactory or completed by the Plumbing Inspector or duly authorized representative. The permit holder shall be notified as to where the work fails to comply with the Uniform Code. Work not installed in compliance with the Code shall be required to remain exposed until it has been verified by the Plumbing Inspector to be in compliance and satisfactorily completed.
A. 
An approved permit for work shall not be issued to the applicant until a fee based on the following has been paid to the City of Amsterdam:
(1) 
Permit fees shall be set by resolution of the Common Council titled "Schedule of Fees," and forwarded to the Division.
B. 
Permits required for building, heating, electrical and sprinklers or other separate contracts included or not included in the architect's or general contractor's estimate shall be paid for by each of the various separate contractors doing work in accordance with the "Schedule of Fees" set forth by resolution and by the Common Council.
C. 
No fee will be required for permits issued for work performed on behalf of the City of Amsterdam on municipally owned buildings, structures or other property.
A. 
The Plumbing Inspector may revoke a plumbing permit issued in the following instances:
(1) 
The permit(s) have been issued in error or are not in accordance with applicable laws.
(2) 
A false statement or misrepresentation as to a material fact in the application, plans or specifications on which the permit was based.
(3) 
Work is being performed without first obtaining a required permit.
(4) 
Work performed or to be performed is determined to be contrary to provisions of the Uniform Code, application plans or specifications, or the building regulations or zoning laws.
(5) 
Where the person to whom the plumbing permit is issued fails or refuses to comply with a stop-work order issued by the Plumbing Inspector and/or the duly authorized representative.
B. 
Wherever the Plumbing Inspector or the duly authorized inspector has reasonable grounds to believe that the work on any building, structure, or premises is being executed in violation of the provisions of any of the applicable building laws, ordinances or zoning regulations, or are not in conformity with the plans and specifications on which the permit was based, or the work is being done in an unsafe and dangerous manner, the inspector shall notify the owner, the owner's agent, or the contractor performing the work the purpose(s) for suspension of any/all operations. Activities shall cease until the stop-work order has been rescinded by the Plumbing Inspector. Work commenced prior to the issuance of a stop-work order shall not resume until the owner and/or his representative is duly notified in writing by the Plumbing Inspector that the stop-work order has been rescinded.
A. 
Whenever the Plumbing Inspector rejects any plan or specifications of any premises, or where he or she claims that plans violate part or parts of the Uniform Code or the Zoning Ordinance[1] or any other building regulations or where he or she disallows a permit because in his interpretation of this ordinance a violation will result, then the owner or applicant may appeal as follows:
(1) 
An appeal involving a question under the Uniform Code shall be taken within six days from the date of the decision of the Plumbing Inspector to the New York State Building Code, Board of Review. A copy of such notice of appeal shall be filed with the Plumbing Inspector at that same time.

B. 
If the decision of the reviewing Board is favorable to the applicant, the Plumbing Inspector shall issue a Plumbing permit in accordance therewith. If the decision of the reviewing board is not favorable to the applicant, compliance shall be met forthwith.
A. 
Upon the satisfactory completion and the final test of the system and all connections, the Plumbing Inspector shall issue a certificate of compliance.
B. 
No plumbing system hereinafter replaced, altered, extended, enlarged, converted, worked upon, maintained, requiring the issuance of a plumbing permit shall be of such a nature as to constitute before its completion a hazardous condition which shall endanger the occupants, shall be used until the Plumbing Inspector has issued a certificate of compliance.
C. 
It is the duty of the Plumbing Inspector to make or direct to have made an examination and inspection during the work in progress and, at its completion, to satisfy himself that the work has been done in a safe manner and in conformity with the plans and specifications filed when the permit was issued and in accordance with this chapter.
D. 
When the final inspection has been made and the inspector is satisfied that the work has been completed in accordance with the Uniform Code, applicable reference standards, and regulations, the inspector shall issue a certificate of compliance within 10 days. This certificate shall be dated; give the permit number; the date of issuance of the permit; the use and occupancy classification of the structure; any special conditions imposed in connection with the issuance of the permit; and the signature of the official issuing the certificate certifying that the work has been done in conformity with applicable laws and regulations.
E. 
Where the Plumbing Inspector has reasonable doubt as to the quality and safety of the work or any part thereof, then he or she may require that the same be subjected to reasonable tests or investigation to make sure of the safety or compliance with the Uniform Code, at the applicant's expense. He or she may require documentary proof of certain materials or require the architect, engineer or certified licensed individual in charge of the job to provide affidavits concerning the workmanship or materials or design of any or all parts of the building. No certificate of compliance shall be issued until all work is in conformity.
