This chapter is enacted pursuant to the authority
granted to municipalities under Article 9-A of the General Municipal
Law of the State of New York and shall be known as the "Games of Chance
Law of the Town of Chautauqua."

Games of chance may be conducted by an authorized
organization, upon obtaining a license from the Town Clerk as provided
in Article 9-A of the General Municipal Law and as provided in this
chapter. Such games of chance shall be conducted in accordance with
the laws of the State of New York, the rules and regulations adopted
by the New York State Gaming Commission and pursuant to the provisions
of this chapter.

The conduct of games of chance shall be subject
to the restrictions imposed by Article 9-A, § 189, of the
General Municipal Law and the rules and regulations adopted by the
New York State Gaming Commission.
Games of chance may be conducted on Sundays
pursuant to this chapter, with the exception that no games may be
conducted on Easter Sunday, Christmas Day or New Year's Eve.
The Chautauqua County Sheriff's Department shall
exercise control over and supervision of all games of chance conducted
under duly authorized license from the town. In exercising such control,
the Chautauqua County Sheriff's Department shall have, in addition
to all the powers already vested therein, those powers and duties
set forth in and for the enforcement of Article 9-A of the General
Municipal Law of the State of New York.
This chapter shall take effect 20 days following
the approval of such chapter by a majority of the qualified voters
of the Town of Chautauqua voting on this proposition therefor, at
the general election held in the Town of Chautauqua, New York, pursuant
to the provisions of the Town Law of the state.
