[HISTORY: Adopted by the Town Board of the

The purpose of this chapter is to regulate the
operation of snowmobiles on public highways in the Town of Chautauqua
in a manner which will be compatible with the use of such highways
and places for vehicular and pedestrian travel and other uses, and
which will promote the safe and proper use of snowmobiles for recreation
and commerce and minimize detrimental effects of such use on the environment.
A.
The terms, words and phrases used in this chapter
shall have the same meanings as such terms, words and phrases as defined
in § 21.05 of the Parks, Recreation and Historic Preservation
Law.

A.
Operation of snowmobiles on highways and public ways
of the Town shall be subject to the applicable provisions of Article
21 through Article 27 of the Parks, Recreation and Historic Preservation
Law, the rules and regulations of the Office of Parks, Recreation
and Historic Preservation and the conditions set forth in this chapter.

B.
The following Town highways, excluding all state,
county and village roads and streets, are hereby designated for the
purpose of operation of snowmobiles on the shoulders and inside banks
thereof as authorized by § 25.05 of the Parks, Recreation
and Historic Preservation Law: Barber Road; Beaujean Road; Beck Road;
Bentley Road; Bloomer Road; Brodt Road; Brumajin Road; Burdick Road;
Canada Road; Card Road; Chautauqua Shores Roads, all; Crawford Road;
Davis Road; Dinsbier Road; Elm Flats Road; Elmwood Road; Hannum Road;
Hewes Road; Lawson Road; Lindberg Road; Lyons Road; McKay Road; Meadows
Road; Mill Street; Mt. Pleasant Road; Munson Road; Parker Road; Potter
Road; Pt. Chautauqua Roads, all; Putnam Road; Quilliam Road; Red Wing
Road; Summerdale Road; Thum Road; Titus Road; Tyler Road; Van Ness
Road; Walker Road; Webber Road; Whallon Street; and Wright Road.[1]

Editor's Note: Former Subsection C, authorizing
the operation of snowmobiles on the roadways of Town highways where
the outside bank or shoulder is impassable, which immediately followed
this subsection, was repealed 1-3-2000 by L.L. No. 1-2000.
Each person operating a snowmobile on any Town
highway shall observe strictly all vehicular traffic signs and signals
and all other rules and regulations applicable to vehicular traffic,
and shall obey the orders and directions of any state or local or
other law enforcement officer authorized to direct or regulate traffic.

A violation of any of the provisions of this
chapter shall be punishable as provided in § 27.11 of the
Parks, Recreation and Historic Preservation Law.

This chapter shall take effect immediately upon
its filing in accordance with the provisions of § 27 of
the Municipal Home Rule Law; provided, however, that no snowmobile
shall be operated under the provisions hereof until such time as the
signs and markers are installed or constructed in accordance with
the requirements of Article 25 of the Parks, Recreation and Historic
Preservation Law and the rules and regulations of the New York State
Office of Parks, Recreation and Historic Preservation.
