An engineer, employee or other official of the Incorporated Village of Lake Grove, or any surveyor performing services for the Incorporated Village of Lake Grove, from and after the effective date of this chapter, may enter upon any lands, waters, streets or places, whether public or private, within the boundaries of the Village of Lake Grove, without interference, hindrance or restraint, for the purpose of making surveys or examinations, including the making of test pits and test borings and the installation of temporary boundary stakes, which are necessary or convenient in the exercise or performance of their powers, duties or services; provided, however, that any such test pits or test borings shall be refilled and any temporary boundary stakes shall be removed and any real property so disturbed shall be restored, so far as is practicable, to its previous condition.
A. 
Any person, whether the owner of the real property involved or otherwise, who shall interfere with or restrain or otherwise prevent such surveyor, engineer, employee or other official of the Incorporated Village of Lake Grove from entering upon or in the places above described, shall be in violation of this chapter and shall be served by the Village Clerk with a written notice, sent by registered or certified mail, stating the nature of the violation and providing a reasonable time limit, not exceeding five days from the date of said mailing, for the satisfactory compliance therewith. The offender shall, within the time period stated in such notice, cease such violation and permit entry as required by this chapter.
B. 
Upon violating any provision of this chapter and upon refusal to comply with the notice aforesaid, such person shall be guilty of disorderly conduct and, upon conviction thereof, shall be liable for and shall pay a penalty in a sum not exceeding $250 for any such offense or shall be subject to imprisonment for a term not exceeding 15 days, or both such fine and imprisonment. In addition, each violation of this chapter or the continued violation of this chapter shall constitute a separate offense for each and every day such violation shall continue.
C. 
In addition, any person violating the provisions of this chapter shall become liable and pay to the village the cost of any expense, loss or damage occasioned the village by reason of such violation.
