The office of Municipal Administrator is hereby
created in and for the Borough of Paramus by and subject to the provisions
of this chapter and in accordance with N.J.S.A. 40A:9-136 et seq.

The Municipal Administrator shall be appointed
by the Mayor, with the advice and consent of the Council. If the Mayor
fails to nominate within 30 days after the office of Municipal Administrator
is created or after the office becomes vacant or the Council fails
to confirm any nomination made by the Mayor, then after the expiration
of said 30 days, the Council shall appoint the Municipal Administrator,
a majority vote having at least three affirmative votes being required
for such purpose, the Mayor to have no vote thereon except in case
of a tie. The term of this office shall be at the pleasure of the
governing body, and removal shall be governed by N.J.S.A. 40A:9-136
et seq.
The Municipal Administrator shall receive such
compensation as shall be fixed, from time to time, by a general salary
ordinance. However, his compensation shall not be reduced during his
term of office except by a two-thirds majority vote of the Borough
Council.
The Mayor may designate a qualified deputy administrative
officer of the Borough subject to the confirmation of a majority of
the Borough Council to perform his duties during his temporary absence
or disability. In the event of his failure to make such designation,
the Council may by resolution appoint an officer of the Borough to
perform the duties of the Administrator during such absence or disability
until he shall return or his disability shall cease.
The Municipal Administrator shall be the chief
administrative officer of the Borough, subject to the policies and
directives of the Mayor and Council. He shall be responsible to the
Council for carrying out policies established by it, for the faithful
enforcement and execution of all ordinances of the Borough and all
state laws subject to enforcement by municipal action and, in general,
for the proper administration of all affairs of the Borough within
the jurisdiction of the Council.

For the purpose of carrying out his duties and
responsibilities under this chapter, within the limitations permitted
by authorized staff and appropriations, the Borough Administrator
shall:
A. Direct and supervise the administration of all departments,
divisions and offices of the Borough government; approve or prescribe
their internal organization; and assign and transfer administrative
functions, powers and duties among and within them, subject to the
provisions of statute and other Borough ordinances.
B. Remove, discipline and recommend for appointment all
department and division heads subject to personnel policy of the Borough;
appoint and remove or discipline all other employees for whose selection
or removal no other method is provided by statute, except that he
may authorize the head of a department to appoint and remove subordinates
in such department; supervise and control his appointees; and report
all appointments or removals at the next meeting thereafter of Borough
Council.
C. Establish and maintain sound working, personnel and
administrative rules, regulations and practices, vacation, holiday,
sick leave and similar schedules and appropriate records and reports,
subject to such general policies as may be established from time to
time by the Borough Council.
D. Attend all meetings of the Borough Council with the
right to take part in the discussions, but without the right to vote,
and be an ex officio nonvoting member of all boards, bodies and commissions
of the Borough to the extent of and subject to any limitations by
statute or legal authority.
E. Prepare annually and recommend to the Council an operating
and a capital budget, together with such explanatory comment or statement
as may be deemed desirable and/or necessary. The operating budget
shall be in such form as is required by law and shall, in addition,
have appended thereto detailed analyses of the various items of expenditure
and revenue.
F. Maintain a continuing review and analysis of budget
operations, work programs and costs of municipal services.
G. Approve and recommend to Council the payment of all
bills and vouchers subject to preaudit and control as prescribed by
law.
H. Negotiate contracts for the Borough subject to the
approval of the Council; make recommendations concerning the nature
and location of municipal improvements; and implement municipal improvements
as determined by the Council.
I. See that all terms and conditions imposed in favor
of the Borough or its inhabitants in any statute, public utility franchise
or other contract are faithfully kept and performed and, upon knowledge
of any violation, call the same to the attention of the Borough Council.
J. Study the governmental and administrative operations
and needs of the Borough government; and prepare and recommend to
the Council for adoption such plans, programs and measures as he may
deem necessary or expedient to meet present and foreseeable needs.
K. Keep the Council advised of the financial condition
of the Borough; make reports to the Council as requested by it; and
at least once a year make an annual report on the administration of
the Borough government for the benefit of the Council and the public.
L. Develop and administer a coordinated or centralized
system for the purchase of supplies, materials, equipment and contractual
services (except professional services, those unique in nature and
not subject to competition and those awarded by resolution of Council)
so as to combine where possible the requests and purchase the same
in bulk quantities and so as to control the commitment of appropriations
for such purchases.
M. Represent the Borough and assert its proper interests
in relation to the United States, the State of New Jersey and other
political subdivisions and their respective agencies, including but
not limited to proposed legislative enactments and available grant-in-aid
or subsidy programs for which the Borough may qualify, in all of such
matters subject to direction of the Council.
N. In cooperation with the Mayor and subject to the additions
by the Council, prepare preliminary agendas of Councilmanic business
for review and consideration by the Council at its conference sessions
and public meetings.
O. Investigate at any time the affairs of any department
of the Borough.
P. Devise and administer a system of referral and follow-up
by operating departments of requests for information regarding municipal
services from members of the public.
Q. Administer programs in the various other areas of
internal housekeeping such as insurance, assignment of office space,
furniture and facilities and inventories of municipal property, real
and personal.
R. Subject to approval by the Mayor and Council, delegate
to department heads such of his powers as he may deem necessary for
efficient administration and utilize such outside consultants, experts,
specialists and tests or other contractual services of a similar nature
as appropriations of funds will permit to achieve maximum efficiency
of operations.
S. Perform such other duties as may be required of the
Municipal Administrator by ordinance or resolution of the Council.
