The Department of Health and Human Services is hereby created.
The Department shall have five divisions as follows:

A. The Department of Health and Human Services shall be overseen by
the Board of Health which is created pursuant to N.J.S.A. 26:3-1 and
shall have all of the powers enumerated in N.J.S.A. 26:3-2.
B. The Board of Health shall consist of five members. The Mayor shall
nominate and, with the advice and consent of the Council, appoint
the members of the Board of Health. Each member shall hold office
for a term of three years, which term shall commence, except in the
case of vacancies, on January 1. Each vacancy shall be filled for
the unexpired portion of the term only.
It shall be the duty of the Board of Health of the Borough to
keep full minutes of its proceedings and to make a report thereof
to the Mayor and Council on the first day of January and July of each
year. Said Board of Health shall also report to the Mayor and Council
in detail the items of its expenses.
The Board of Health shall elect a President from among its own
membership. It shall appoint a Secretary, Registrar of Vital Statistics,
Clerk and Sanitary Inspector. The Board may also appoint such other
officers and assistants as the Board may deem necessary. All appointees
of the Board shall be governed by the rules of the Board, and they
may be removed for cause by the Board.
The Board shall adopt and regulations for its own government
and that of its officers and employees not inconsistent with law or
the State Sanitary Code.
Members of the Police Department shall report to the Board every
violation of any health ordinance which comes within their observation
and knowledge.
The Board of Health shall not contract any debt or debts of
any kind beyond the amount of appropriations made for its use by the
Council.

All licenses subject to the Board of Health's jurisdiction
shall be subject to the same investigatory procedure as Chapter 191-3B
of the Borough Code, except that the Board of Health has instituting
authority for such investigations to the same (or greater extent)
as the Borough Clerk.
