In the event that any dog, whose owner resides
within the municipality, is found to be a potentially dangerous dog
pursuant to N.J.S.A. 4:19-23, said dog shall be issued a potentially
dangerous dog registration number and a red identification tag along
with a City of Paterson potentially dangerous dog license. Said license
shall be issued to the owner only upon demonstration that the owner
has complied with any orders issued regarding the potentially dangerous
dog pursuant to N.J.S.A. 4:19-16 et seq. The last three digits of
the potentially dangerous dog registration number shall be the three-digit
code assigned to the City of Paterson by the State of New Jersey pursuant
to N.J.S.A. 4:19-16 et seq. Said license shall only be issued by the
City Clerk upon written notice from the Animal Control Officer of
compliance with the terms of this section.
The municipality shall designate and publicize
a telephone number for reporting violations of N.J.S.A. 14:19-16 et
seq., including the suspected presence of any potentially dangerous
or vicious dogs.
The fee for a potentially dangerous dog license
shall be $150.
In order to obtain the issuance of a potentially
dangerous dog registration number and license, the owner must comply
with the following conditions:
A. Maintain liability insurance in the amount determined
by the Animal Control Officer to cover any damage or injury caused
by the potentially dangerous dog. Said liability insurance shall contain
the provision that the City of Paterson be named as an additional
insured for the sole purpose of being notified upon the cancellation,
termination or expiration of said liability insurance policy.
B. Immediately erect and maintain an enclosure for the
potentially dangerous dog on the property where the potentially dangerous
dog will be kept and maintained, which has sound sides, top and bottom
to prevent the potentially dangerous dog from escaping by climbing,
jumping or digging and is within a fence of at least six feet in height
separated by at least three feet from the confined area. The owner
of a potentially dangerous dog shall securely lock the enclosure to
prevent the entry of the general public and to preclude the release
or escape of a potentially dangerous dog by an unknowing child or
other person. All potentially dangerous dogs shall be confined in
the enclosure or, if taken out of the enclosure, securely muzzled
and restrained with a tether approved by the animal control officer
and having a minimum tensile strength sufficiently in excess of that
required to restrict the potentially dangerous dog's movements to
a radius of no more than three feet from the owner and under the direct
supervision of the owner.
