Editor's Note: This ordinance repealed former Art. I, Newspapers,
adopted 12-12-1974, as amended.
As used in this article, the following terms shall have the meanings
indicated:
Recyclable aluminum beverage cans.
The type commonly referred to as "corrugated cardboard" consisting
of ridges and grooves. All other cardboard is excluded.

Bimetal/tin cans and white goods such as large appliances.

All products made from silica or sand, soda ash and limestone which
are transparent or translucent and used for packaging or bottling of various
matter and all other materials commonly known as "glass," excluding, however,
blue and flat glass commonly known as "window glass."
Commercial and institutional establishments shall separate and place
out for collection hi-grade office paper. "Hi-grade office paper" is defined
as the following: tab cards, white letterhead, ledger paper, nonglossy copier
paper and computer paper.

Dry cell batteries to include common cells (alkaline, zinc and lithium),
nickel-cadmium (rechargeable) and button cells (silver oxide, mercuric oxide,
lithium, zinc, air and alkaline-managanese).

Paper of the type commonly referred to as "newsprint" and distributed
at stated intervals, usually daily or weekly, having printed thereon news
and opinions and containing advertisements and other matters of public interest.
Included in this definition shall be magazines, telephone books, shinnies,
catalogs, real estate multiple-listing books and similar periodicals but expressly
excluded are items known as "junk mail" and all other paper products of any
nature whatsoever.

Composed of either PET or HDPE material such as clear, transparent
or opaque plastic beverage, detergent and milk containers.

All materials designated by this article or future ordinances to
be separated from solid waste.
Such rules, implementation dates, schedules of times and such other
requirements promulgated by the Recycling Coordinator and approved by the
Borough Council as may be necessary to carry out the purposes and objectives
of this article.
All garbage and rubbish normally placed out by the residential and
commercial occupants of the Borough of Upper Saddle River.

All persons, organizations, institutions, commercial establishments,
except those physically disabled, who are owners, lessees and occupants of
residential and commercial property shall source separate mixed paper, corrugated
cardboard, ferrous metal, aluminum, plastics and glass from any solid waste
produced and shall separate the same for pickup, collection and recycling,
in accordance with all applicable regulations.

Aluminum, glass, plastic and bimetal/tin cans may be commingled in one
reusable container. All separate recyclables shall be placed for pickup, collection
and recycling in strict conformity with the following regulations:
A.Â
Newspaper shall be separated and secured in bundles tied
with string or placed in brown paper bags not to exceed one foot in height.
Magazines, telephone books, shinnies, catalogs and real estate multiple-listing
books shall be bundled in brown paper bags or tied with string not to exceed
one foot in height.
B.Â
Aluminum shall be separated, crushed and secured in suitable
reusable containers supplied by the owner, lessee or occupant.
C.Â
Glass shall be separated and unbroken and contained in
suitable reusable containers supplied by the owner, lessee or occupant. Containers
constructed of paper or cardboard materials or plastic bags shall be deemed
not suitable for this purpose. Glass should be reasonably rinsed and metal
caps, rings and plastic tops removed.
D.Â
Plastics shall be separated and placed in suitable reusable
containers supplied by the owner, lessee or occupant. Plastic containers of
PET or HDPE material should be cleaned with lids/caps removed.
E.Â
Corrugated cardboard shall be separated and tied with
string not to exceed one foot in height, and two feet in length and width.
F.Â
Bimetal/tin cans shall be cleaned, free of food and placed
in suitable reusable containers.
G.Â
Household-generated batteries shall be brought to the
recycling depot.

The Recycling Coordinator shall promulgate reasonable regulations establishing
the commencement dates for mandatory separation of recyclables and the manner,
dates and times for the collection of the same in accordance with the terms
of this article. Any such regulations promulgated by the Recycling Coordinator
shall be approved by the Borough Council and may be changed, modified, repealed
or amended in whole or in part by majority vote of the Borough Council. A
copy of such regulations promulgated by the Recycling Coordinator, as approved,
modified or amended, shall be available for public inspection at the office
of the Borough Clerk during regular office hours.

A.Â
From the time of placement for pickup, collection and
recycling, recyclables not containing chlorofluorocarbons (CFC's) or urethane
insulation shall be the property of the Borough of Upper Saddle River or its
duly authorized agent.
B.Â
Any recyclable item such as a refrigerator or similar
appliance containing chlorofluorocarbons or urethane insulation shall remain
the property of the homeowner until such time as the CFC's or urethane insulation
have been removed. The Borough shall be under no obligation to pick up and
collect items containing CFC's or urethane insulation unless the same have
been removed from the appliance.
C.Â
No person unauthorized by the Borough of Upper Saddle
River shall collect or pick up or cause to be collected or picked up any recyclables.
Each collection or pickup of recyclables in violation hereof from any one
or more residences shall constitute a separate and distinct offense.
The Recycling Coordinator, Board of Health, police, Department of Public
Works or their duly authorized designated persons are hereby authorized as
the enforcement officers of this article.

For violation of any provision of this article, the maximum penalty shall be in accordance with § 1-15 of this Code.
