Pursuant to N.J.S.A. 40:63-7[1], the following sewer rents and charges are hereby fixed and prescribed
for use of sanitary sewers in the Borough of Upper Saddle River:
B.
For properties connected to the Borough of Ramsey:
(1)
Each single-family dwelling or each apartment unit shall
be charged on the same basis and at the same rate as charged to Ramsey properties
for the charge per million gallons as set forth by the Northwest Bergen County
Sewer Authority for the year in which said charges are made beginning on January
1 of said year. The water consumed, as measured by water meter over the winter
quarter (December, January and February) will be used as a basis for determining
the wastewater discharged to the Ramsey sanitary sewerage system. Where occupancy
occurs subsequent to the winter quarter, the users sewer charge shall be based
upon an estimated water consumption of 20,000 gallons per quarter, provided
that the user uses in excess of 20,000 gallons during the quarter when occupancy
is commenced. At the next winter quarter, the previous sewer billings shall
be adjusted, based on actual winter-quarter water consumption.
(2)
Each commercial, industrial and institutional building
shall be charged on the same basis and at the same rate as charged to Ramsey
properties for the charge, including any applicable surcharges per million
gallons as set forth by the Northwest Bergen County Sewer Authority for the
year in which said charges are made beginning on January 1 of said year. The
water consumed, as measured by water meter over the winter quarter (December,
January and February) will be used as a basis for determining the wastewater
discharged to the Ramsey sanitary sewerage system. Surcharges by the Northwest
Bergen County Sewer Authority are based on characteristics of the sewage and
other wastes and any other special matter affecting the cost of treatment
and disposal thereof, including chlorine demand, biochemical oxygen demand,
concentration of solids and chemical composition; and this in turn shall be
applied to the flow discharge of Upper Saddle River properties, as applicable.
Where occupancy occurs subsequent to the winter quarter, the users sewer charge
shall be based upon an estimated water consumption of 20,000 gallons per quarter,
provided that the user uses in excess of 20,000 gallons during the quarter
when occupancy is commenced. At the next winter quarter, the previous sewer
billings shall be adjusted, based on actual winter quarter water consumption.
(3)
Each property shall be subject to Ramsey's operation
and maintenance charge at the same rate as charged to Ramsey properties plus
10% in addition thereto.
(4)
Except when exempted pursuant to the agreement between
Upper Saddle River and Ramsey, each property shall be subject to the annual
capital cost for Ramsey sewerage facilities to be raised for the ensuing year
at the same rate as charged by Ramsey to its sewerage system users.
(5)
Each property shall be subject to any surcharges imposed
by Ramsey in accordance with Paragraph 22 of the Ramsey-Upper Saddle River
Agreement if the flow from the property exceeds the maximum average daily
flow set forth in such agreement.

The charges payable pursuant to § 110-1 shall be levied and shall become due as follows:
A.
For properties connected to Woodcliff Lake and Montvale,
the charges shall be due and payable from such property owner 30 days after
the rendering of a bill from Upper Saddle River.
B.
For properties connected to Ramsey, the charges shall
be paid by such property owner to Ramsey unless Ramsey has notified Upper
Saddle River that the charges remain unpaid, in which event the charges shall
be due and payable from such property owner 30 days after the rendering of
a bill by Upper Saddle River.
A.
No property shall be connected to the sewers of Upper
Saddle River serviced by Woodcliff Lake and Montvale and no permit shall be
issued for any such connection unless and until the owner making such connection
shall have paid a connection fee of $4,500 to the Borough of Upper Saddle
River for transmittal to Woodcliff Lake and Montvale pursuant to the agreement.
B.
Each property eligible for connection to the Ramsey system
but not contributing flow to the Ramsey sewers as of June 18, 1979, shall
pay Ramsey a capacity charge of $700 at the time the subject property is connected
to or utilizing the Ramsey sewer system. In the event that Ramsey gives notice
to Upper Saddle River that any such charge remains unpaid, the amount of such
charge shall be due and payable to the Borough of Upper Saddle River within
30 days of the rendering of a bill therefor.
A.
Each property owner connected to the Upper Saddle River
system that is serviced by Woodcliff Lake and Montvale shall be governed by
all rules and regulations imposed upon users of the Woodcliff Lake and Montvale
Sewer Systems, which regulations are incorporated herein by reference. In
the event of a conflict between the regulations of Montvale and Woodcliff
Lake, the more stringent requirements shall govern.
B.
Each property serviced by the Ramsey system shall be
governed by all rules and regulations imposed upon users of the Ramsey sewer
system, which regulations are incorporated herein by reference.
C.
In the event that Upper Saddle River suffers any cost,
damage or expense as a result of noncompliance by a property owner with such
rules and regulations, said property owner shall, within 30 days after rendering
of a bill by Upper Saddle River, pay the amount of such cost, damage and expense
to the Borough of Upper Saddle River.
Such charges for connection with and use of the sewers shall draw the
same interest from the time they become due as taxes upon real estate in the
Borough, and shall be a lien upon the premises connected until paid. The Borough
shall have the same remedies for collection thereof with interest, costs and
penalties, as it has by law for collection of taxes on real estate.
In the event of any amendment of the agreements between the Borough
of Upper Saddle River and the Borough of Ramsey, Montvale or Woodcliff Lake,
the charges set forth in this chapter shall be deemed amended to conform to
any such amended agreement effective upon the adoption of an ordinance approving
such amended agreement.
