As used in this chapter, the following terms shall have the meanings
indicated:
Yard trimmings, rags, waste wood or cardboard and other combustible
solids of a nonvolatile or nonexplosive nature.
Waste or decayed animal or vegetable matter that has been used or
was intended to be used as food and the waste therefrom, and dead animal or
plant life or parts of the same.
Those materials naturally formed from trees and bushes that are suitable
for composting and/or mulching purposes.

All solid waste material which does not burn.
All residential, commercial and institutional property owners and/or
occupants within the Borough of Upper Saddle River.

Includes all coal or wood ashes, all loose material and dirt-like
substances and all waste material accumulated from buildings or the cleaning
of buildings.
All garbage and trash normally collected by rear yard pickup from
the residents of the Borough of Upper Saddle River by regular twice-weekly
municipal collection.

All food establishments, restaurants, food processing places and all
retail and wholesale business establishments shall provide a room to store
garbage. The refuse floor of the room shall be concrete at finished grade
level. The room may be attached to the main structure with no opening directly
to the main building. The structure shall be of masonry construction, properly
ventilated and insect- and rodent-proof. The size of the room shall be determined
by the estimated volume of garbage or refuse. The provisions of this section
shall apply only to new construction or material alterations of existing structures.
A.
Any vehicle used in the collecting, transporting or disposing
of materials or substances shall have a closed, watertight metal body and
shall at all times be maintained and operated in a cleanly and sanitary manner.
Vehicles shall be kept closed at all times except while actually being filled
or emptied.
B.
All vehicles and receptacles shall be available for inspection
by the Health Officer at all reasonable hours.
A.
Garbage shall be thoroughly and completely drained of all liquids, wrapped securely in paper and placed in a receptacle as described in § 183-5.
B.
Noncombustible waste shall not be mixed with other refuse
when prepared for disposal by incineration.
C.
Paper shall be secured and properly tied into bundles
or other packages in a manner to prevent any scattering while awaiting or
during collection. The bundles or packages shall be of a size and weight to
permit ease of handling by one man.
D.
Combustible waste shall be stored and held in receptacles
separate and apart from noncombustible waste when prepared for disposal by
incineration.
E.
Combustible or noncombustible waste of such a nature
that it cannot be deposited in a receptacle shall be securely and properly
tied into bundles or packages to prevent spilling or scattering. The bundles
or packages shall be of a size and weight to permit ease of handling by one
man.
F.
All leaves shall be separated from municipal solid waste
generated within the Borough of Upper Saddle River and are prohibited from
inclusion in all regular rear yard and curbside collection of garbage.

A.
The owner, tenant, lessee and occupant of any house,
store or other building shall be obligated to place or cause to be placed
in a metal, watertight box, barrel or other receptacle which shall have a
tight cover and be kept tightly closed at all times, all coal or wood ashes,
plaster and all other household refuse and decaying vegetable and animal substances
upon his premises. All receptacles shall be kept in a place accessible for
emptying by authorized collectors and shall be maintained in a sanitary condition.
B.
The owner or occupant of every retail food establishment
shall provide and keep on the premises and use for all refuse a receptacle
having a capacity of not less than one cubic yard. All receptacles shall be
watertight, constructed of metal or plastic, equipped for handling by motorized
equipment, maintained in a clean and sanitary condition and replaced by the
same type of receptacle if removed for emptying.
C.
Receptacles that are badly broken or otherwise fail to
meet the requirements of this section may be classed as refuse and collected
and disposed of as such by the person or agency responsible for the collection
of refuse.
D.
Receptacles shall be conveniently located on the premises
for storage of refuse and shall be maintained in such manner as to prevent
creation of a nuisance or menace to public health.

On and after September 1, 1988, it shall be mandatory for all persons
who accumulate leaves to separate them from municipal solid waste and be responsible
for their disposal. Nothing herein contained shall be construed as prohibiting
any person from accumulating leaves for compost or mulching purposes for their
personal horticultural benefit, provided that same has no adverse effect upon
or does not violate health and safety codes.

A.
The Mayor and Council may from time to time promulgate
rules and regulations to effectuate the separation and disposal of leaves.
B.
The provisions of this chapter regarding leaf separation
and disposal, and any regulations promulgated hereunder, shall be enforced
by the Borough Clerk, the Road Department Superintendent the Police Department
and any such other employees or departments of the Borough as the Borough
Clerk shall designate in writing.

Any person who violates or neglects to comply with any provision of
this chapter or notice issued pursuant thereto shall, upon conviction thereof,
be liable to a penalty of not less than $5 nor more than $500 for each violation.
