It shall be unlawful for any person to advertise
or conduct a sale for the purpose of discontinuing a retail business
or to modify the word "sale" in any advertisement with the words "going
out of business" or any other words which tend to insinuate that the
retail business is to be discontinued and the merchandise liquidated,
unless such person obtains a permit to conduct such sale from the
Board of Supervisors as prescribed by this article.
Applications for special sale permits required by § 139-1 above shall be filed with the Clerk of the Board of Supervisors at least 14 days prior to the date of such sale and the next regular meeting of the Board of Supervisors.
A.
Applications for special sale permits shall contain
the following information:
(1)
The name of the person conducting such sale.
(2)
The legal address of the place where such sale is
to be conducted.
(3)
An inventory of all goods which are to be offered
for sale during such special sale.
(4)
Written notification from the County Attorney that
he has inspected the advertisement and inventory of such sale and
has found such advertisement and inventory to be in conformity with
the provisions of this article.

B.
A fee as set by resolution of the Board of Supervisors
shall accompany such application. Such fee shall be deposited in the
general fund of the County.

A.
The Board of Supervisors shall issue such special
sale permit at its next regular meeting following the date of the
filing of an application for such special sale permit, provided that
the application for such permit is in conformity with the provisions
of this article.
B.
Each sale permit shall be valid for a period of 60
days, and any extension of such period shall constitute a new special
sale and shall require an additional permit.

The Board of Supervisors shall cause inspections
to be made of such special sale to ensure that such sale shall be
conducted in conformity with the provisions of this article.

Any person guilty of a violation of the provisions
of this article shall be guilty of a misdemeanor punishable by a maximum
fine of $2,500 or by imprisonment for not more than 12 months, or
by both such fine and imprisonment.
