A. 
The Director of the Public Works Division, and all other employees of this Division, shall be employed/appointed in accordance with Section 61 of the City Charter.
B. 
The Director shall be responsible to the Mayor and the Board of Public Works for the satisfactory performance of the duties and functions assigned to his division. These duties shall be comprised of the following functional areas and such other duties as may be assigned by the Mayor and/or the Board of Public Works:
(1) 
Sewage treatment. The director is responsible for the satisfactory operation of the sewage treatment facilities operated by the City or which may be operated by the City in the future. The Director is authorized to delegate this responsibility to a qualified engineer who shall manage the treatment plants of the City and who shall be responsible to the Director.
(2) 
Civil engineering. There shall be appointed, in accordance with Section 61 of the City Charter, a City Engineer, who shall perform those duties and functions prescribed by law, the City Charter, and City ordinances. (See §§ 5-64 through 5-68.) The City Engineer shall be responsible to the director and shall perform such additional functions/duties as may be prescribed by the Director, the Mayor and/or the Board of Public Works.
(3) 
Traffic engineering. There shall be appointed, in accordance with Section 61 of the City Charter, a Traffic Engineer, who shall perform the traffic engineering functions required by the City. The Traffic Engineer shall also be responsible for the construction and erection of traffic signs (in cooperation with the appropriate aldermanic committee), the maintenance and operation of traffic signals, as well as the coordination of federally funded traffic improvement and signalization projects with the state and federal highway departments and other traffic-related operations. The Traffic Engineer shall be responsible for the satisfactory completion of his assigned functions to the Director of the Public Works Division. The Traffic Engineer shall provide liaison to the appropriate aldermanic committee. The Traffic Engineer shall also perform such duties/functions as may be assigned by the Director of the Public Works Division, the Mayor and/or the Board of Public Works.

(4) 
Streets and equipment maintenance. The Director of the Public Works Division shall be responsible for the maintenance of the Division's equipment and the maintenance and repair of the streets, sewers and drains of the City. The Director shall also be responsible for the satisfactory provision of sanitation services. The Director may delegate this authority to a Superintendent of the Streets Department, who shall be appointed in accordance with Section 61 of the City Charter and who shall be responsible for the satisfactory performance of his duties to the Director. He shall also perform such duties/functions as may be assigned by the director, the Mayor and/or the Board of Public Works.
(5) 
Parks and Recreation Department. The Director shall be responsible for the maintenance of City parks and for the development and implementation of recreation activities. Such authority and duties may be delegated to a Park Superintendent and/or Recreation Director appointed in accordance with Section 61 of the City Charter. The control of City parks by the Public Works Division shall be limited to the improvement and maintenance of City parks. Purchase and designation of City land for recreational use shall remain the function of the Board of Aldermen acting by the Lands and Buildings Committee. This legislation shall be implemented upon the physical relocation of the Recreation Department to the proposed Greeley Park addition.
(a) 
There shall be no construction at Greeley Park except for construction approved by a majority of the Board of Aldermen by ordinance after a public hearing. "Construction," as used in this section, shall be construed broadly, including but not limited to any new construction of any type of structure, monument, and/or renovation or rehabilitation of an existing structure. This subsection is not intended to prohibit the Parks and Recreation Department from repairing, maintaining or otherwise servicing structures fully constructed and operational as of December 31, 2006. If applying for any building permit or demolition permit which would come within the scope of review of the Historic District Commission for that part of Greeley Park deemed applicable in § 190-2, the Board of Aldermen shall first seek an advisory opinion of the Historic District Commission as provided for in § 190-22C.

(b) 
The Parks and Recreation Department shall be responsible for operating all youth sports programs in the City with funds allocated for the programs by the Board of Aldermen.
(c) 
Public bathrooms will be constructed and located on the east side of Greeley Park. A new gazebo will be purchased and installed in Greeley Park.

(d) 
The City shall not sell any contiguous part of the Holman Stadium parcel (Assessor’s Map 63, Lot 52, as of July 1, 2010). In the alternative, if the City does ever sell any noncontiguous part of the Holman Stadium parcel, the abutter(s) to the property to be sold will have a first right of refusal to purchase the property.

(6) 
The Director of the Public Works Division shall be responsible for the satisfactory operation of the City's sanitary landfill, the collection of municipal solid waste and any other related solid waste operations and duties. The Director may delegate this duty to a Superintendent of Solid Waste, who shall be appointed in accordance with Section 61 of the City Charter and who shall be responsible for the satisfactory performance of his/her duties to the Director. He/she shall also perform such duties/functions as may be assigned by the Director, the Mayor and/or the Board of Public Works.
(7) 
Liaison functions. The Director of the Public Works Division shall be the official liaison between the City and the Cemetery Trustees in all areas regarding maintenance/improvements to the City's cemeteries.
