No person shall throw or deposit litter in any park within the township,
except in public receptacles and in such a manner that the litter will be
prevented from being carried or deposited by the elements upon any part of
the park or upon any street or other public place. Where public receptacles
are not provided, all such litter shall be carried away from the park by the
person responsible for its presence and properly disposed of elsewhere.
No person shall throw or deposit litter in any fountain, pond, lake,
stream, bay or any other body of water in a park or elsewhere in the township.
No person shall sweep into or deposit in any gutter, street or other
public place the accumulation of litter from any building or lot or from any
public or private sidewalk or driveway.
No person who owns or occupies a place of business shall sweep into
or deposit in any gutter, street or other public place the accumulation of
litter from any building or lot or from any public or private sidewalk or
driveway. Nothing contained herein shall prevent the sweeping or leaves into
the gutters or streets of the township during periods which may be officially
designated by the township as periods for the collection of leaves.
Persons placing litter in public receptacles or in authorized private
receptacles shall do so in such a manner as to prevent it from being carried
or deposited by the elements upon any street, sidewalk, road, alley or other
public place or upon private property.
Every person who owns or occupies property shall keep the sidewalk in
front of his premises free of litter. Every person who owns or occupies a
place of business shall keep the sidewalk in front of his business premises
free of litter. The owner, tenant or occupant referred to in this section
shall be guilty of a violation of this section if such owner, tenant or occupant
had actual notice of the presence of the litter and failed or refuses to correct
the condition within a reasonable time thereafter, or if the litter remained
on the premises or on the sidewalk in front of the premises for a sufficiently
long period of time to give rise to constructive notice of its presence.
It shall be unlawful for any person to tamper with or take or remove any of the contents of any private or public receptacle containing garbage, refuse, rubbish, junk or any other waste material which has been placed or deposited along any public highway, street, land or alleyway for collection by the township or any of its agents or servants, and such person who violates the purpose and intent of this section shall be subject to the penalties set forth and established in §
152-27.
No person, while a driver or passenger in a vehicle, shall throw or
deposit litter upon any street or other public place within the township or
upon private property.
No person while in an aircraft shall throw out, deposit upon or within
the township any litter, handbill or any other object.
All persons operating filling stations or other mercantile establishments
where commodities are sold between any curb area of the township and the office
building or equipment from which such commodities are dispensed shall maintain
at all times covered receptacles into which all such waste materials and rubbish
may be deposited by customers, employees or other persons.
No person shall post or fix any notice, poster or other paper or device
calculated to attract the attention of the public to any lamppost, public
utility pole, shade tree or upon any structure or building or upon any official
traffic control devices as defined in N.J.S.A. 39:1-1 et seq., except as may
be authorized or required by law.
Debris resulting from the demolition and/or construction of a structure
on a construction site shall be placed in a receptacle or stored in such a
manner that it will not be carried away or deposited by the elements onto
property adjacent and/or contiguous to the construction site. The accumulation
of debris on construction sites shall be prohibited.
