A. 
The Zoning Enforcement Officer shall determine from the application the number of cubic yards proposed to be excavated or removed and shall certify this amount to the Town Clerk.
B. 
Fee amounts.

(1) 
The Town Clerk shall charge and collect for each permit a minimum fee as provided by resolution of the Town Board for any proposed excavation volume not exceeding 10,000 cubic yards.
(2) 
For any proposed excavation exceeding 10,000 cubic yards but not exceeding 20,000 cubic yards, the Town Clerk shall charge and collect for each permit a minimum fee as provided by resolution of the Town Board.
(3) 
For any proposed excavation exceeding 20,000 cubic yards, an additional fee shall be charged in an amount as provided by resolution of the Town Board per each cubic yard or fraction thereof.
(4) 
In lieu of the foregoing fees, the applicant, with the Town Board's approval, may pay a fixed annual fee as provided by resolution of the Town Board for any amount of removal. No credit shall be permitted on next year's fee for any applicant electing this method of payment.
C. 
On the expiration of said permit, the licensee shall be permitted a credit on the next year's excavation fee for any fee paid on a proposed excavation which was not completed in the preceding year. This credit shall not be applied toward the minimum annual fee as referred to above.
D. 
If a permit holder determines that his excavating requirements exceed those authorized under his permit, he must amend his original application, pay whatever additional fees are required and obtain an amended permit before excavating beyond the authorized amount.
A bond or cash deposit shall be posted with the Zoning Enforcement Officer as required by § 70-6 of this chapter, which bond or cash deposit to be determined by the Town Board shall in no event be less than $1,000 for each proposed acre of excavation.
