The Chief of Police shall install and maintain
traffic control devices when as required under the provisions of this
chapter, to make effective the provisions of this chapter. He may
install and maintain such additional traffic control devices as he
may deem necessary to regulate, warn or guide traffic under the Vehicle
and Traffic Law of the State of New York, subject to the provisions
of § 1682 and § 1684 of that law.
The traffic pavement markings upon New York
State roadways are hereby applicable to Town and county roadways in
the Town of Cheektowaga. Said markings, when placed upon Town and
county roadways, shall have the same meaning and effect as similar
markings upon state roads in this town. Violations of such markings
upon said Town and county roadways shall be subject to the same penalties
as violations of such markings on state roadways.
If any article, section, subsection, paragraph,
sentence, clause or provision of this chapter shall be adjudged by
any court of competent jurisdiction to be invalid, such adjudication
shall not affect, impair or invalidate the remainder thereof. Such
adjudication shall be confined in its operation to the article, section,
subsection, paragraph, sentence, clause or provision thereof directly
involved in the controversy in which such judgment shall have been
rendered.
All prior ordinances, regulations and rules,
or parts thereof, of this Town regulating traffic and parking are
hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person or any act done or committed
in violation of any ordinance, regulation or rule hereby repealed
prior to the taking effect of this chapter.
Every person convicted of a traffic infraction
for a violation of any provision of this chapter, which is not a violation
of any provision of the Vehicle and Traffic Law of the State of New
York, shall for a first conviction thereof be punished by a fine of
not more than $250 or by imprisonment for not more than 15 days, or
by both such fine and imprisonment. For a second such conviction within
18 months thereafter, such person shall be punished by a fine of not
more than $500 or by imprisonment for not more than 15 days, or both
such fine and imprisonment. Upon a third or subsequent conviction
within 18 months after the first conviction, such person shall be
punished by a fine of not more than $750 or by imprisonment for not
more than 15 days, or by both fine and imprisonment.
The provisions of this chapter shall apply to
all areas of the Town of Cheektowaga, Erie County, New York, outside
the Villages of Depew and Sloan.
