Motion-picture projectors using nitrate film shall be operated by and
be in charge of qualified licensed projectionists who shall not be minors.
Any person or persons or firm or corporation violating any of the provisions
of this chapter or who shall fail to comply with any order issued and served
pursuant to the provisions of this chapter or any other person who commits,
takes part in or assists in any such violation or who maintains any building
or premises, or any part thereof, in which any such violation shall exist
shall be deemed a disorderly person and guilty of a misdemeanor and shall
be liable to a fine not to exceed one hundred dollars ($100.) or to a penalty
of one hundred dollars ($100.) for each offense or to imprisonment, or to
both such fine and imprisonment; and if any such violation shall continue
for more than twenty-four (24) hours, such continuation shall be deemed a
separate violation for each twenty-four (24) hours.
The imposition of a penalty as herein prescribed shall not preclude
the institution of any appropriate action or proceeding in a court of competent
jurisdiction to compel compliance with or to restrain by injunction the violation
of this chapter or to prevent the occupancy of any building, structure or
premises.
