A. 
All on-street vending of food is prohibited with the following exceptions:
(1) 
Food sold at a fair authorized by the Board of Trustees;
(2) 
Food sold by charitable organizations; and
(3) 
Food sold from licensed ice cream trucks.
B. 
No one can sell ice cream from a truck without first obtaining a license from the Village of Pelham. To obtain the license the applicant must:
(1) 
Complete an application for an ice cream vendor license;
(2) 
Supply a copy of a valid New York State driver’s license for every person driving the truck as well as proof of current registration and current inspection of the truck to be used. Ice cream vendors shall be fingerprinted and shall submit to a criminal background check.
(3) 
Provide the Village with a certificate of insurance in the amount fixed by resolution of the Board of Trustees; and
(4) 
Pay the license fee set by resolution of the Board of Trustees.
Christmas trees cannot be sold within the Village of Pelham without first satisfactorily completing a Christmas tree vendor permit and paying the permit fee as set by resolution of the Board of Trustees. Not-for-profit charitable organizations are not required to obtain a permit under this section.
