As used in this article, the following terms
shall have the meanings indicated:
SNOW EMERGENCY
An accumulation of ice or snow during any period in which snow plows or snow removal equipment shall be operating within Franconia Township when determined to present hazardous driving conditions pursuant to the provisions of §
137-19 of this article.
VEHICLES
Every device in, upon or by which any person or property
is or may be transported or drawn upon a highway, including trailers
and taxicabs but excluding other public transportation conveyances
and police, fire and emergency vehicles.
When a snow emergency has been declared:
A. No vehicle shall be parked on any Franconia Township
roads or streets.
B. No vehicle shall be parked in areas otherwise reserved
for parking in the core of culs-de-sac.
C. A vehicle driven upon Franconia Township roads or
streets which becomes stalled or incapable of moving under its own
power or any such vehicle left unattended is hereby prohibited.
D. Any vehicle parked, stalled or incapable of moving
under its own power or left unattended upon any road or street in
Franconia Township may be removed or towed away at the owner's expense
to another location at the direction of any Franconia Township police
officer.
It shall be the duty of all owners, tenants
or occupants of occupied properties, and the owners or agents in charge
of unoccupied properties, abutting on public streets in Franconia
Township, not later than 30 hours after snow or sleet has ceased to
fall, to clear or cause to be cleared a pathway in the sidewalk in
front of their respective properties in the event of snow and to cover
the sidewalk with cinders, sawdust or similar snow and ice control
materials in the event of ice and sleet. Such pathway shall not be
less than 30 inches in width and shall be thoroughly cleared of snow
and ice or covered in cinders, sawdust or similar snow and ice control
materials. Where snow and ice are removed from the pathway, it may
be placed or piled on the curb side of the sidewalk, but it shall
not be piled or placed in the gutter or the cartway.

This chapter shall be enforced by action brought
before a District Justice in the same manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure.
Any person who violates or permits the violation of this chapter shall,
upon conviction in a summary proceeding, be punishable by a fine of
not more than $1,000 per violation or by imprisonment for a term not
exceeding 90 days. Each section of this chapter that is violated shall
constitute a separate offense.
