Unless otherwise provided, the provisions of
this chapter shall apply to all taxicabs, livery vehicles and other
vehicles of any kind, character and description which are engaged
in the business of transporting passengers for hire from any point
of origin within the City to any destination within the City. The
following are excepted from the provisions of this chapter:
A.
Any vehicle operated by a person or company and used
to transport persons who are the employees, patrons, guests, residents,
or customers of the person or company and where the provision of such
transportation is incidental to the business of such person or company.
B.
Any school bus within the meaning of MGL c. 90,
§ 1.
C.
Any vehicle operated as a common carrier within the
meaning of MGL c. 159A.
As used in this chapter, the following terms
shall have the meanings indicated:
A license granted by the Superintendent and issued by the
Police Department permitting the holder thereof to operate a licensed
taxicab or livery vehicle.
Any unmarked vehicle which engages in the transportation
of passengers only at a predetermined rate pursuant to a prearranged
contract for hire.
A vehicle license granted by the Superintendent of Police
and issued by the Police Department for the operation of said vehicle
as a livery. A livery license issued pursuant to this chapter shall
permit said vehicle to engage in the transportation of passengers
only pursuant to a prearranged contract for hire. A licensed livery
vehicle shall not be permitted to engage in the transportation of
passengers on a demand basis pursuant to a hail fare.
The Superintendent of the Lowell Police Department or his
authorized designee.
Any vehicle which engages in the transportation of passengers
pursuant to a prearranged contract for hire or on a demand basis pursuant
to a hail fare at a rate based upon time and/or mileage.
A vehicle license granted by the Superintendent of Police
and issued by the Police Department for the operation of said vehicle
as a taxicab. A taxicab license issued pursuant to this chapter shall
permit said vehicle to engage in the transportation of passengers
pursuant to a prearranged contract for hire and on a demand basis
pursuant to a hail fare at a rate based upon time and/or mileage.
