The provisions of this chapter shall apply to the sale of burial rites in lots in all Town cemeteries.
Burial rites to cemetery lots will be sold only to residents of the Town, with the following exceptions:
A. 
The sale of lots in Veteran's Field shall not be restricted to residents of the Town;
B. 
Sales shall be permitted to former Town residents who have lived for a period of one year or longer in the Town;
C. 
The sale of lots in the Hebrew Cemetery shall not be restricted to residents of the Town; provided, however, that any nonresident must be a member of the congregation of Temple Beth Sholom, Incorporated.
A. 
Purchase of burial rites to cemetery lots will be restricted to residents and former residents for their own family use, and lot owners are prohibited from selling or transferring lots except to the Town.
B. 
For purposes of this section, the word "family" shall be defined as all heirs in a lineal family line, spouses, brothers and sisters of the record owner.
In the event of transfer of a burial rite cemetery lot back to the Town, the Town will refund no more than the amount originally paid for the burial lot proportionately reduced by the number of interments in it.
No portion of the real property owned by the Town and known and described as the East Cemetery in the Town shall be used for the location of a Town garage or other Town facility made necessary, in whole or in part, by the actual or anticipated sale, exchange, lease or abandonment of the park department garage located at 16 Harrison Street, in the Town.
