As used in this chapter, the following terms shall have the meanings
indicated:
ABANDONED MOTOR VEHICLE
Any motor vehicle that is unregistered, has invalid marker plates,
or is so damaged, vandalized, dismantled, partially dismantled, inoperative,
or unusable as a motor vehicle.
MOTOR VEHICLE
Any device propelled by any power, other than human power, that is
or was capable for the conveyance, drawing or other transportation of person
or property, whether operated on wheels, runners, a cushion of air, or by
any other means, and shall include, but not be limited to, automobiles, trucks,
tractors, and motorcycles.
PERSON
In addition to its ordinary meaning, includes associations, firms,
partnerships, and corporations.
PRIVATE PROPERTY
Includes any and all property, other than that owned by the state,
or a political subdivision of the state.
No person in charge or control of any private property within the Town
of Montville, whether as owner, tenant, occupant, lessee, or otherwise, shall
allow abandoned motor vehicles to remain on such property.
This chapter shall not apply to:
A. Vehicles within closed buildings.
B. Motor vehicles located on the premises of a business
enterprise, lawfully licensed by the city or state.
C. Any motor vehicle which is in operable condition, specifically
adapted or designed for operation on drag strips or raceways:
(1) Only two such vehicles shall be permitted at one time
on the property in question.
(2) Motor vehicle parts used in the restoration must be stored
in the vehicle or in a structure.
(3) Such motor vehicles shall be covered with a tarpaulin
whenever work is not being done on them.
D. Any inoperable motor vehicle being restored to operating
condition, provided that:
(1) Only one such vehicle shall be permitted at one time
on the property in question;
(2) Motor vehicle parts used in the restoration of the vehicle
must be stored in the vehicle or in a structure.
(3) Such motor vehicles shall be covered with a tarpaulin
whenever work is not being done on them.
E. Any vehicles used exclusively on farms.
Violation of this chapter shall be punishable by a fine not to exceed
$50 per vehicle. Each day such violation is committed or permitted to continue
shall constitute a separate offense and shall be punishable as such hereunder.
Any assessed penalties shall be collected by the Town Treasurer.
The owner of the property on which such motor vehicle is abandoned shall
be liable for all costs involved in the removal of such vehicle. In the event
that the owner of such property does not reimburse the Town for all such removal
expenses within 60 days of notice of such expense, a lien shall be placed
upon said property by the Town.
