No vehicle whose primary use is as a trailer,
including but not limited to travel trailer, house trailer, camper,
boat or boat trailer, shall be parked on the public streets of the
Town of Elsmere, except for such a time as may be necessary to immediately
load or unload such trailer.

A. Any member of the Elsmere Fire Company who has been
appointed as a fire police officer may apply for a designated parking
space.
B. All requests for a designated parking space shall
be submitted in writing to the Elsmere Chief of Police, so that he
or she may issue an opinion and make a recommendation to Council.
C. A copy of the each request shall be distributed to
the Special Services Director, so that it may be determined if it
is possible to place sign poles at the requested site; and the Special
Services Director will meet with the Chief to check the logistics
of installation.
D. Restricted parking spaces shall be provided only to
those possessing a letter from the Fire Chief advising that they are
currently serving as a fire police officer of the Elsmere Fire Company.
E. One parking space only shall be provided for each
such vehicle.
F. The parking space designated shall be on the street
and shall be determined by the Chief of Police and the applicant.
G. No designated parking space shall be provided if the
applicant has a driveway on his or her property.
H. A sign shall be placed at the parking site stating
"RESTRICTED PARKING." This sign shall display the vehicle registration
number that has been assigned to the applicant's vehicle through the
Delaware Division of Motor Vehicles. The area will be designated a
tow-away zone. A yellow curb will be painted to designate the space.
I. All costs involved in providing the parking space
shall be borne by the Town of Elsmere.
J. A restricted parking space shall terminate and revert
back to public parking immediately upon notification by the Fire Chief
that the applicant is no longer serving as a fire police officer or
change of residence.
K. The fine for unauthorized parking in the area shall
be not less than $100 nor more than $300, plus court costs, plus the
cost of towing and storage of the vehicle.
L. Final determination of eligibility for a restricted
parking space shall be made by the Mayor and Council of the Town of
Elsmere.
M. Parking in restricted parking spaces; violations and
penalties.
(1) Fire police officers who have obtained a handicapped
parking space granted by the Town of Elsmere must park their designated
vehicle in that space and no other within 200 feet.
(2) Fire police officers who park their designated vehicle
outside their designated handicapped parking space, but within 200
feet of that space, shall be fined not less than $100 nor more than
$300 for a first offense.
(3) Fire police officers who park their designated vehicle
outside their designated handicapped parking space, but within 200
feet of that space, for a second offense shall have that vehicle towed
away and the space shall be revoked for a year. The fire police officers
shall be responsible for all towing and impoundment costs. After one
year has passed, such fire police officers may reapply to the Council
for a restricted parking space.
(4) Reapplication for a parking space shall follow the
same procedure as the original application.
Whoever knowingly commits a violation of this
chapter shall be fined not more than $100 or imprisoned no more than
30 days, or both. Each and every day during which such violation shall
occur, after written notice thereof, shall be deemed a separate offense.
