The Board of Water and Light Commissioners for the City of New Castle
is hereby authorized and empowered to trim or to remove any tree or bush within
the limits of the City of New Castle where the trimming or removal of such
tree or bush is necessary for the safe and proper distribution by the City
of Electric current and light along or over any of the streets, roads or alleys
of the said city; provided, however, that any owner or occupant of the property
along or on which such tree or bush is located, who disputes the necessity
for the trimming or removal of such tree or bush, shall have the right to
appeal to the Council of the city; and on being notified by such owner, in
writing, of such appeal, the Board of Water and Light Commissioners shall
cease such trimming or removal until the necessity thereof shall have been
heard and decided by the Council of the city. In case of any such appeal,
the President of the Council shall, if necessary, at once call a special meeting
of Council to act upon such appeal, and the matter shall be heard and decided
without delay.
