As used in this article, the following terms shall have the meanings indicated:
COMMERCIAL USER
Any user using water for business purposes other than for manufacturing.
CONNECTION FEE
Fee charged for the right of the user to connect to the system as set forth in Chapter 66, Fees.
HOTEL
A building or portion of it which is used as such for the lodging of guests. The term "hotel" includes an apartment hotel, motel, boardinghouse or club, whether or not meals are served.

HOTEL ROOM
A room of any kind in any part or portion of a hotel, which is available for or let out for any purpose other than a place of assembly. A bathroom which adjoins and is directly accessible to a hotel room and solely serves the guest(s) of that hotel room shall be considered part of that hotel room.

INDUSTRIAL USER
Any user using water for manufacturing purposes, including but not exclusive of making, finishing, bottling, canning, cleaning, or laundering of any article in whole or part.
MAIN
As used in singular or plural, the pipes, other than supply lines and service pipes, used for conveying water to or distributing water through the system.
METER HORN
Specialized piece of pipe designed to allow a hookup and mounting of a water meter in the existing water line.
METER RATES
Rates or charges for water based on quantity consumed as measured by an approved water meter.
NONRESIDENTIAL UNIT
A facility, building, structure or part thereof which is not used as a residential unit, such as but not limited to a business, office, commercial establishment, industrial facility, hotel, motel, restaurant, tavern, church and school.

NONRESIDENTIAL USER
One or more users owning, renting and/or occupying a single nonresidential unit which receives water provided by the Water Department.

RESIDENTIAL UNIT
A single- or multiple-family dwelling, apartment, condominium unit, townhouse, trailer or mobile home, which is designed for and used exclusively as a residence. The conduct of a home occupation in conformity with Borough zoning ordinances will not disqualify the unit from being classified as a residential unit.

RESIDENTIAL USER
One or more users owning, renting and/or occupying a single residential unit which receives water provided by the Water Department.

SERVICE LINE
The pipe extending from the curb cock or valve to the meter, usually on privately owned land, for supplying the premises with water.
SUPPLY LINE
Pipe connected to the main and extending to and including the curb cock or valve at or about the curb line of the street.
SYSTEM
The water supply system of the Borough of Andover.
TAPPING FEE
Connection fee.
USER
A person, corporation, company, society, firm, partnership, association, organization or any group or entity operating as a unit which or who owns, rents and/or occupies a residential unit or nonresidential unit receiving water provided by the Water Department.

WATER DEPARTMENT
The Andover Borough Water Department.
WATER RENTAL
All fees charged or chargeable to a user and/or property owner.
A. 
All new users shall meter their water supply upon connection to the water supply system.
B. 
All commercial and industrial users shall, on or before December 31, 1968, meter their water supply.
C. 
All other users shall meter their water supply on or before December 31, 1972.

A. 
Every user shall install, at his own expense, a meter horn provided by the Water Department and a service shutoff valve at the point of entry of the water service into his property in accordance with the specifications of the Water Department.
B. 
Any user making written application to the Water Department for a meter horn shall be furnished a meter horn upon payment to the Water Department sufficient to reimburse the Water Department for its cost for the meter horn plus 15% administrative cost.
C. 
All meter horns and water shutoff valves shall be installed by the user within 90 days after the issuance or within 30 days prior to the date established above for installation of water meters, whichever date is earlier.
D. 
Every user shall notify the Water Department of the completion of the installation of the meter horn and water shutoff valve.

A. 
Upon notification to the Water Department by the user that his or her meter horn and shutoff valve have been installed, the Water Department shall furnish and shall install the meter unless the Water Superintendent shall authorize installation by a third party approved by the Water Superintendent and selected by the user.
B. 
No meter shall be installed unless the meter horn, piping connections and shutoff valve have been installed in accordance with the specifications of the Water Department.
C. 
Upon complaint of a user and payment by the user of the meter checkout fee as prescribed by Chapter 66, Fees, a Borough water meter shall be disconnected, removed and tested. If the meter test discloses the meter reading inaccurate with a deviation greater than 5%, the meter shall be repaired or replaced by the Water Department and the meter checkout fee credited to the user's account. The Water Department or its authorized representative shall perform the meter testing. If a user requests testing by an independent agency, the user and the property owner shall be responsible for all costs incurred by the Water Department which shall be due on presentation of the bill and, if not paid within 30 days after its due date, be subject to interest and penalties in accordance with Chapter 66, Fees.

The Water Department, its employees and agents, carrying identification cards with photographs attached, shall have access at all reasonable hours to a user's property for the purpose of installing water meters and, after the installation of said meters, for the purpose of inspecting, maintaining and reading the water meters and associated equipment. The hours between 8:00 a.m. and 4:30 p.m., Monday through Friday, and 8:00 a.m. and 12:00 noon on Saturday shall be considered reasonable hours for these purposes. If Water Department personnel are unable to gain access after three reasonable attempts over a period of three weeks, then it shall be construed that the property owner has denied access and will be subject to estimated billing by the Borough.

A. 
No fixture of any kind from which water can be drawn shall be placed on the street side of the water meter, except with permission of the Water Department.
B. 
After installation, the water meter shall remain the property of the Water Department.
C. 
Every user shall be responsible for the protection of the meter due to freezing, hot water or otherwise or damage to the meter due to negligence or carelessness. Repairs to or replacement of meters so damaged shall be at the expense of the property owner.
D. 
The Water Department may repair, replace or exchange meters, as it deems necessary.
E. 
No person except an employee or designated representative of the Water Department shall connect, disconnect, repair or adjust or tamper in any way with a water shutoff, line, water meter, curb cock or valve or its associated equipment or the water meter seal.
F. 
The property owner shall be responsible for the installation, maintenance and repair of the service line and shall keep the same in good repair and protect it from damage due to freezing or other causes. All leaks in the service line shall be reported promptly to the Water Department and immediately repaired by the property owner. If repairs are not so made, the water shall be shut off by the Water Department and shall not be turned on until the disconnection and reestablishment fees prescribed by Chapter 66, Fees, are paid and the pipe is put in serviceable condition as determined by the Water Department.
G. 
In case of emergency, the Water Department may repair a service line, and if so, the cost of the repair work shall be charged by the Water Department to the user as part of the water rental and shall be due upon presentation of the bill. If the bill is not paid within 60 days after presentation to the user, the provisions of §§ 130-8, 130-9 and 130-19 shall apply.

Charges for water consumption shall be computed as set forth in Chapter 66, Fees.

B. 
In the event that a user's meter does not register his use charges shall be prorated on the basis of previous charging experience.
C. 
In the event that a user fails to take necessary steps to have a meter properly installed in accordance with the specifications of the Water Department on or before the date established by § 130-13, the quarterly unmetered water rent shall be double the amount of the unmetered charge as established by the Water Department.
The Water Department, upon notice to the user, may discontinue service to any user for any of the following reasons:
A. 
Failure to take the necessary steps to have a meter properly installed in accordance with specifications of the Water Department before the date established in § 130-13 for installation of water meters.
B. 
Failure to pay water meter charges or service charges when due in accordance with rates and regulations established by the Water Department.
C. 
Violations of any of the provisions of this article or violation of any rules and regulations duly adopted by resolution of the Water Department.

Any person who violates any provision of this chapter, upon conviction before the Municipal Court Judge, shall, in addition to the penalty set forth in § 130-19 above, be subject to the penalties provided for in Chapter 1, General Provisions, § 1-15.
