The constitutional officers are the County Clerk, Sheriff, Surrogate and County Prosecutor. In accordance with the Charter, this chapter is not intended to change the powers or duties of these officers.
The officers, employees, property and activities under the jurisdiction of each of the constitutional officers, as provided by law, shall respectively constitute a department with the constitutional officer as its head.

To the extent that these officers and agencies are supported by County appropriations, they shall be subject to County direction and supervision with respect to programs, functions, powers and duties as may be otherwise provided by law and shall be subject to the requirements of the Charter and this chapter and shall follow standard County procedures as to budgetary matters, central data processing services, financial and accounting controls, personnel and central purchasing. These officers shall retain the right to appoint and dismiss their own personnel subject to budgetary considerations and personnel procedures.
