The Division of Human Resources is hereby authorized to initiate a criminal history record check on the final candidate for appointment to those positions in the County which have been determined by the Division of Human Resources to warrant such investigation.
A. 
The list of positions for which a criminal history record check is required will be kept by the Division of Human Resources and included in the Division's Policy and Procedure Manual.
B. 
The Division of Human Resources shall consider the following factors in developing the list of titles for which a criminal history record check is required:
(1) 
The position involves interaction with a highly vulnerable or at-risk population, such as but not limited to the frail, elderly, juveniles and others whose natural defenses may be impaired.
(2) 
The position is one where the appointee will have access to sensitive or confidential information.
(3) 
The appointee will have access to the County's financial system.
(4) 
Such other considerations as are prudent and reasonable.
The Division of Human Resources shall process the requests for criminal history record checks through the Department of Public Safety, Division of Adult Detention, Office of Internal Affairs.
The Department of Public Safety is authorized to submit applicant fingerprint cards and/or name/date of birth request forms and to receive state criminal history record information from the Division of State Police, State Bureau of Identification, on behalf of the Division of Human Resources for use in considering the suitability of all applicants covered under this Article.
All requested criminal history record checks will be subject to the state's required user fee, which shall be paid for by the candidate.
All information obtained will be kept confidential and used only in accordance with any applicable laws or regulations, including the County and Division Policy and Procedures Manuals.
The County shall adopt a policy outlining the permissible use of information obtained in a criminal history record report and the measures which will be taken to assure confidentiality. The policy shall comply with all applicable laws and regulations.
