As used in this chapter, the following terms
shall have the meanings indicated:
DEPARTMENT
The Atlantic County Department of Public Safety.

DIVISION
The Atlantic County Division of Parks and Recreation. Park
Rangers, operating under the authority of the Atlantic County Department
of Public Safety, Office of Emergency Preparedness, shall be the enforcing
agency for the park system.

EXCLUSIVE USE
The right of a group to use a designated parks area where
the general public is excluded.
OPEN SPACE
Any dedicated or nondedicated land or water owned or controlled
by the County or in which the County may have an interest that is
or could be used for recreation, conservation or preservation purposes.
PARKS AREA
Any area(s) under the jurisdiction of the Division of Parks
and Recreation, including all County parks, open spaces, recreational
facilities, historic areas and cemeteries. The term "park areas" shall
include Atlantic County bike paths and bikeways.

PERSON
Any natural person, corporation, company, association, joint-stock
association, firm or partnership.
PUBLIC ASSEMBLIES
Includes demonstrations; picketing; or religious services,
meetings and gatherings; and all other like forms of conduct which
involve the communication or expression of views or grievances, engaged
in by one or more persons, the conduct of which has the effect, intent
or propensity to draw a crowd or lookers. This term does not include
casual park use by visitors which does not have an intent or propensity
to attract a crowd or onlookers.
RESERVED USE
The advance arrangement to have the use of designated County
facilities without the right to exclude the general public from the
area.
RULE OR REGULATION
Includes any state law, rule or regulation, the provisions
of a County ordinance, written rules issued by the Department or Division
and a directive of a County park ranger or park supervisory personnel.
SPECIAL EVENT
Includes sports events, pageants, celebrations, historical
reenactments, regattas, entertainments, performances, exhibitions,
parades, fairs, festivals and similar events which are not public
assemblies and which are engaged in by one or more persons, the conduct
of which has the effect, intent or propensity to draw a crowd or onlookers.
The term does not include casual park use by visitors which does not
have an intent or propensity to attract a crowd or onlookers. The
term “special event” shall also include any bike-a-thon,
walk-a-thon and similar group bicycle or pedestrian events.

The provisions of this chapter shall be interpreted
using the following precepts:
A. Any term in the singular shall include the plural,
and the plural shall include the singular.
B. Any term in the masculine shall include the feminine
and neuter.
C. The requirement or prohibition of any act shall, respectively,
extend to and include the causing or procuring, directly or indirectly,
of such act.
D. No provision of this chapter shall make unlawful any
act necessarily performed by any officer or employee of the Department
in the line of duty, or work by any person, his or her agents or employees,
in the proper and necessary execution of the terms of any agreement
with the Department or County.
This chapter and all other appropriate rules
and regulations of Atlantic County or the Department shall be effective
within all parks areas of Atlantic County and shall regulate conduct
therein by all persons.
If any provision of this chapter shall be determined
by a court of competent jurisdiction to be invalid, such determination
shall not affect the validity of the chapter as a whole or any provision
thereof other than that which is declared invalid.
