As used in this article, the following terms
shall have the meanings indicated:
DIVISION
The Atlantic County Division of Public Health.
HEALTH OFFICER
The Director of the Atlantic County Division of Public Health.
INDIVIDUAL
Includes any natural person or his or her legal representative,
partnership, corporation, company, trust, business entity or association
and any agent, employee, salesperson, partner, officer, director,
member or stockholder thereof.
PRIVATE DRINKING WELL WATER
A water conveyance system not connected to a public water
system, which is designed to deliver potable water for human consumption
to one or more individuals.
A laboratory, when submitting a water analysis
from a private drinking water well must indicate, in writing, the
place from where the water sample was taken and must also indicate,
in writing, whether the sample represents treated or untreated (raw)
well water. The laboratory must further certify that the sample was
collected by a trained representative of its firm and that the sample
was collected, transported and analyzed in accordance with the procedures
set forth in the New Jersey Department of Environmental Protection's
Field Procedures Manual for Water Data Acquisition.
The Division shall evaluate the sample test
results against the standards set forth in the New Jersey State Primary
and Secondary Drinking Water Standards. The Division shall, within
five days after receipt of the sample test result, issue, in writing,
to the individual a statement detailing the reasons for acceptance
or rejection of such sample. The Division, at its discretion, may
reject the sample result, either in whole or in part, and may require
that an additional test be conducted at the expense of the individual.
In such an event, the Division shall set forth, in writing, the basis
upon which the Division relies in requiring the taking of additional
tests.
Any individual who has submitted test results
to the Division and who has received written rejection of such results
or has been required to conduct additional tests may request a review
of such decision by the Health Officer by submitting a request, in
writing, to the Health Officer within 20 days after notice of such
rejection. The Health Officer shall, within five days after receipt
of such notice, review the decision of the Division and may modify,
reject or uphold the Division's determination.

The fee for evaluation shall be as indicated in Ch.
73, Fees, Art.
VII, Atlantic County Division of Public Health Services, for each analysis.
