There shall be a Municipal Court for the borough, pursuant to provisions
of N.J.S.A. 2B:12-1 et seq., as amended, to be known as the "Municipal Court
of the Borough of Bay Head, Ocean County, New Jersey." The Municipal Court
shall have a seal which shall bear the impress of the name of the Court and
shall exercise all the functions, powers, duties and jurisdiction conferred
by law upon municipal courts.
The courtroom of the Municipal Court shall be located in the Municipal
Building of the borough. The Municipal Court shall sit upon such dates and
at such hours as may, from time to time, be fixed by resolution of the Borough
Council, along with such other dates and times as may be required, from time
to time, to complete the business of the Court, consistent with all applicable
statutes and rules of the Court governing the administration thereof.

There shall be a Municipal Judge of the Court who shall be appointed
by the Mayor, with the advice and consent of the Borough Council, for a term
of three (3) years, in accordance with the provisions of N.J.S.A. 2B:12-4,
as amended. He shall receive such annual salary as may, from time to time,
be determined by the Borough Council by ordinance. The compensation paid to
the Municipal Judge shall be in lieu of any and all other fees or gratuities.

There shall be an Administrator of the Municipal Court who shall be
appointed by the Borough Council by resolution, together with other necessary
clerical or other assistants for the Municipal Court and which shall provide
therein for their compensation. Such compensation shall be in lieu of all
other fees, costs and other allowances.

All requests for discovery in matters pending in the Borough of Bay
Head Court shall be submitted through the Municipal Prosecutor.
The following fees shall be payable by the requestor to the Borough
for the discovery provided:
A. For each of the first 10 pages photocopied: $0.75 per
page.
B. For each of the next 10 pages photocopied: $0.50 per
page.
C. For each of the pages photocopied thereafter: $0.25 per
page.
D. Actual postage for any discovery sent by mail.
E. For the envelope for any discovery sent by mail: $0.25.
F. Photographs will be photocopied at the rates established
herein. If requests are made for duplicate photographs, the actual cost of
making the photographs shall be charged.
G. Duplication of videotapes constitutes an extraordinary
duplication process and will be charged at the rate of $5 per videotape.
H. On any item that cannot be photocopied on the Borough
copy machine or not otherwise provided for in this schedule, the actual cost
incurred in making the copy shall be charged.
Where the discovery must be obtained from an entity other than the Borough
of Bay Head, e.g., another police department, the actual costs paid to the
other entity shall be paid by the requestor.
