The Police Department of the Borough is hereby established and
shall consist of the ranks or positions of Chief of Police, Captain,
Lieutenant, Sergeant, Detective, patrolman and special law enforcement
officers, as the Mayor and Council may from time to time designate
and appoint.
The Mayor and Council hereby subdelegate the
authority to promulgate rules and regulations concerning the conduct
and duties of the officers and men, the uniform and insignia to be
worn and such other matters as may be necessary for the proper management
and regulation of the Police Department to the Chief of Police and
Police Committee of Council. Such rules and regulations shall be adopted
by resolution and shall be known as "Police Department Rules and Regulations"
and shall be binding upon each member and employee of the Department.
The headquarters of the Police Department shall
be established in the municipal building of the Borough of Bay Head.
The Mayor and Council may establish such substations as may from time
to time be necessary for the proper enforcement of the laws and for
the better protection of the borough and its inhabitants.

A. Special law enforcement officers shall be authorized to perform all
duties and responsibilities allowed to be performed as provided in
the Special Law Enforcement Officers Act, subject to the supervision
and direction of the Police Chief. Special law enforcement officers
may be employed as either Class One and/or Class Two special law enforcement
officers, as those classifications are established and described in
the Special Law Enforcement Officers Act, N.J.S.A. 40A:14-146.8 et
seq.
B. The number of Class One special law enforcement officers hired by
the Borough shall be at the discretion of the Police Chief, but shall
not exceed ten Class One special law enforcement officers. Class One
special law enforcement officers shall meet all the requirements and
terms for appointment and continued employment which are set forth
in the Special Law Enforcement Officers Act.
C. The number of Class Two special law enforcement officers hired by
the Borough shall be at the discretion of the Police Chief, but shall
not exceed ten Class Two special law enforcement officers. Class Two
special law enforcement officers shall meet all the requirements and
terms for appointment and continued employment which are set forth
in the Special Law Enforcement Officers Act.

A. The
Chief of Police shall have the right to issue general orders to members
of the Police Department concerning extra duty performed for outside
contractors to ensure that public safety needs of the community are
appropriately addressed and that such outside employment is carried
out in accordance with applicable state rules and regulations.
B. Extra-duty
work performed by police officers for outside contractors, which assignments
are undertaken at the sole option of the employee, shall be paid through
the payroll system of the Borough. The general work rate shall be
$75 per hour, with the employer being permitted to subtract an administrative
charge of $15 per hour, netting the employee $60 per hour. If extra
work is performed between 7:00 p.m. and 7:00 a.m., the work rate shall
be $85 per hour with the employer being permitted to subtract an administrative
charge of $15 per hour, netting the employee $70 per hour.
