§ 146-1 Definitions; time standard.

Words and phrases. Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey shall be deemed to apply to such words and phrases used herein.

Official time standard. Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight savings time as may be in current use.

§ 146-2 Authorization for the closing of any street.

The Road Commissioner is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.

Any regulations promulgated by the Road Commissioner and in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.

Any violation of this regulation promulgated thereunder shall be punishable by a fine not to exceed $50.

Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the New Jersey Department of Transportation.

§ 146-3 Tow-away.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace office may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

§ 146-4 Violations and penalties.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $250 or imprisonment for a term not exceeding 15 days, or both.

§ 146-5 Severability.

If any part or parts of this ordinance are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

§ 146-6 Repealer.

All former traffic ordinances of the Township of Bethlehem are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

§ 146-7 Traffic controls for street and highway construction and maintenance operations; adoption of manual.

Traffic controls shall be required when the Road Commissioner finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above or below the ground which requires blocking the street and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work forces performing these operations.

The Township of Bethlehem in the County of Hunterdon, State of New Jersey, does hereby adopt the current Manual on Uniform Control Devices for Streets and Highways hereafter known as the "MUTCD," except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of the MUTCD while performing such work is in violation of this section.

Preconstruction meetings. It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, Section 16:25-9.2, wishing to conduct work on, under or above the street to contact the Municipal Engineer of the Township of Bethlehem in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Municipal Engineer of the Township of Bethlehem is in violation of this section.

Hazardous conditions. The person, contractor or utility shall provide at least two emergency contact telephone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, emergency contact cannot be made, or if the emergency contact person does not respond to a call from the Municipal Engineer or Office of Emergency Management to correct such hazardous condition, the Township of Bethlehem may respond to correct the hazardous condition(s). The reasonable fees for such emergency services by the Township of Bethlehem shall be charged to the person, contractor or utility responsible for the condition.

Hours. There shall be no construction, maintenance operations or utility work on any roadway in the township before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Road Commissioner. If it is determined by the Road Commissioner that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. to 4:00 p.m. These hours limiting construction, maintenance operations or utility work shall not apply to the Municipal Department of Public Works.

Road closing. Road closing and/or traffic detours shall not be permitted unless approved by the Road Commissioner or Office of Emergency Management.

Traffic directors. Traffic directors shall be posted at all construction or maintenance sites when determined by the Road Commissioner or Municipal Engineer that same is necessary to provide for the safety and expeditious movement of traffic.

Stop work. The General Code Enforcement Officer, or the Township Engineer if no Code Enforcement Officer is available, shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

Site preparation. It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction signs, light devices and pavement markings are installed.

Violations and penalties.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the county jail for a term not exceeding 90 days; for a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the county jail for a term not exceeding 90 days.

A separate offense shall be deemed committed on each day during or on which violation occurs or continues.

§ 146-8 Regulations not exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

§ 146-9 Parking prohibited during state of emergency.

Upon the declaration of an emergency, there shall be no parking upon the streets where temporary EMERGENCY NO PARKING signs are displayed. The Road Commissioner or the Office of Emergency Management is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

The effectiveness of this section is contingent upon the signs being erected as required by § 146-7B as contained herin.

§ 146-10 Temporary parking prohibition for snow plowing and removal; removal of vehicle.

Whenever snow has fallen and the accumulation is such that it covers the streets and highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

§ 146-11 Stopping or standing prohibited during certain hours on certain streets.

§ 146-17 Parking of certain trucks, vehicles and trailers prohibited.

No person shall park any truck or vehicle over three tons' gross vehicle weight (GVW), a school bus, any other type of bus, recreational vehicle, camper, boat or trailer between the hours specified upon any of the streets or parts of streets described.

§ 146-19 Routes for trucks over 15 tons.

Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets as described are hereby designated as routes for vehicles over 15 tons. All trucks having a total combined registered gross weight of vehicle plus load in excess of 15 tons shall be excluded from all streets, except from those streets listed which form a part of the system of truck routes. Vehicles will be permitted on all streets for the purpose of the pickup and delivery of materials.

§ 146-35 Handicapped parking.

Handicapped parking on streets. In accordance with the provisions of N.J.S.A. 39:4-197, the following street locations are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special identification cards or plates or placards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces.

Signs, pavement markings, installation and maintenance. The owners of the premises referred to § 146-35C, D and E shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Bethlehem. The owner shall be responsible for the repair and restoration of same.

§ 146-36 Control for movement and parking of traffic on public and private property.

Regulation for the movement and the parking of traffic on municipal property and Board of Education property. In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate or park a vehicle in violation of the regulations indicated.

Regulation for the movement and the parking of traffic on private property open to the public and to which the public is invited (retail business).

In accordance with the provisions of N.J.S.A. 40:48-2.46, on the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.

The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the current Manual on Uniform Traffic Control Devices (MUTCD). The cost of signs and installations shall be the responsibility of the owner of said property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Bethlehem.

The penalty for a violation and conviction of this section shall be not less than $50 nor more than $1,000 and/or imprisonment in the county jail for a term not to exceed 90 days, or by a period of community service not to exceed 90 days.

Regulation for the movement and the parking of traffic on all other private property. In accordance with the provisions of N.J.S.A. 39:5A-1, the regulations of Subtitle 1, Title 39 of the Revised Statutes are hereby made applicable to the properties listed below.

Signs, pavement markings, installation and maintenance. The owners of the premises referred to in Subsections B and C shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Bethlehem. § 146-37 Regulations applicable to Municipal Building.

General parking.

All vehicles must park in designated areas and between the lines provided.

No person shall stop or stand a vehicle upon any of the streets or parts of streets or areas described below, except in areas covered by other parking restrictions.

Handicapped parking. All stalls shall be 12 feet wide, as shown on the attached site plan,[3] and signed with R7-8 and R7-8P signs (Reserved Parking Sign and Penalty Plate), in the designated parking areas for persons who have been issued a handicapped parking permit by the Motor Vehicle Commission.

Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits authorized by the Department of Transportation.

Tow-away zones. Any vehicle parking or standing as to obstruct or impede a normal flow of traffic, blocking entrances or exitways, loading zones, oil fills, any grassy area pedestrian walkway, or presenting in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.

All signs, posts, or other necessary materials shall be installed and paid for by the Township of Bethlehem. All signing shall conform to the current Manual on Uniform Traffic Control Devices pursuant to N.J.S.A. 39:4-198 and 39:4-183.27.

Unless another penalty is expressly provided for by the New Jersey Statute, every person convicted of a violation of this section or any supplement thereto shall be liable to a penalty of not more than $500 or imprisonment for a term not exceeding 15 days, or both.

§ 146-38 General regulations applicable to Heritage Park.

General parking.

All vehicles must park in designated areas and between the lines provided.

No person shall stop or stand a vehicle upon any of the streets or parts of streets or areas described below, except in areas covered by other parking restrictions.

Rules and regulations for use of the park and recreation facilities.

Specific rules and regulations governing the use of Heritage Park and its recreation facilities shall be established by the Township Committee by resolution from time to time ("park rules and regulations"). The park rules and regulations shall be kept on file in the Municipal Clerk's office and copies shall be available at the Municipal Building for the public.

The park rules and regulations will set forth, but are not limited to, the following:

(a)

Priority of users;

(b)

Reservation of facilities;

(c)

Sales on park property;

Waivers;

Fees and charges;

Alcohol/tobacco use;

Park use rules;

Liability insurance requirements;

(i)

Certification of coaches; and

(j)

Use of walking trail.

The park rules and regulations shall supersede any conflicting provisions in this chapter except for state motor vehicle laws applicable to public roadways.

The park rules and regulations, as amended from time to time, shall be incorporated herein and made a part of this chapter by reference.

Regulations for use of the parking lot.

Specific regulations governing the use of the parking lot shall be established by the Township Committee by resolution from time to time ("parking lot regulations"). The parking lot regulations shall be kept on file in the Municipal Clerk's office and copies shall be available at the Municipal Building for the public.

The parking lot regulations will set forth, but are not limited to, the following:

(a)

Number of parking stalls;

(b)

Size of each parking stall;

(c)

Location of each parking stall;

(d)

Location of regulatory and/or directional signs;

(e)

Location of utility pole curbline;

(f)

Width of parking lot entrance;

(g)

Width of lane(s) of travel; and

(h)

Location of landscaped island(s).

The parking lot regulations, as amended from time to time, shall be incorporated herein and made a part of this chapter by reference.

All signs, posts, or other necessary materials shall be installed and paid for by the Township of Bethlehem. All signs shall conform to the current Manual on Uniform Traffic Control Devices pursuant to N.J.S.A. 39:4-198 and 39:4-183.27.

Enforcement. The Zoning Official, Director of Public Works and/or Township Committee members (the "Township") shall have the authority to enforce the provisions of this chapter, which includes the state motor vehicle laws. The Township shall have the authority to eject from the park any person acting in violation of this chapter. The Township shall have authority to issue summonses before the Municipal Court to any person acting in violation of this chapter. In addition, the Township shall have the authority to issue summonses to any person violating any provisions of this chapter based on the filing of certified complaints by private persons.

Violations. Any person violating any of the provisions of this section shall, upon conviction thereof, be subject to the penalties provided in § 1-15. Each such day such violations are committed or permitted to continue shall continue a separate offense and shall be punishable as such hereunder.
