Nothing in this chapter shall be construed to prohibit both the parent
of a child who is alleged to have violated this chapter and the child from
being prosecuted for the same offense. If a child is alleged to be in violation
of this chapter more than 1/2 hour from 10:00 p.m. on Sunday, Monday, Tuesday,
Wednesday or Thursday or more than 1/2 hour after 11:00 p.m. on Friday or
Saturday, it shall be presumed that the parent permitted such child to loiter
or congregate in the manner prohibited in this chapter.
Any person who shall violate any provision of this chapter shall be
subject to the following mandatory penalty:
A. For the first offense, a fine of not less than $35 nor
more than $50.
B. For the second offense, a fine of not less than $50 nor
more than $100.
C. For the third or subsequent offense, a fine of not less
than $100 nor more than $250.
