This Part 1 shall be known and may be cited as the "Uniform Code Enforcement
Ordinance of the City of Auburn."
The purpose of this Part 1 is to provide for enforcement procedures
in the City of Auburn for the New York State Uniform Fire Prevention and Building
Code, hereinafter called "Uniform Code."
A.
The City is responsible for the administration and enforcement
of the Uniform Code for all private buildings, premises and equipment located
within the City of Auburn.
B.
The City is also responsible for the administration and
enforcement of the Uniform Code with respect to buildings, premises and equipment
in the custody of, or activities related thereto undertaken by, the City of
Auburn or any special purpose unit created by or for its benefit, although
no building permit or certificate of occupancy shall be required. The City
shall not be responsible for those of another city, or village, town or county.
C.
The state is responsible for the administration and enforcement
of the Uniform Code with respect to buildings, premises and equipment in the
custody of, or activities related thereto undertaken by, a state department,
bureau, commission, board or authority.
D.
The State Education Department shall likewise administer
and enforce the Uniform Code for school districts and boards of cooperative
educational services.
E.
To the maximum extent practicable, the City acting under
this section shall consult with those other governmental entities providing
services, under authority of other laws, to those areas where the authority
conferred by this section is exercised.
The words and terms used in this Part 1 shall have the same meaning as those contained in Executive Law Article 18 as added by Chapter 707 of the Laws of 1981, unless the context may otherwise require.
A.
Single-station smoke detecting alarm devices shall conform
to the requirements of Part 850 of the New York State Uniform Fire Prevention
and Building Code.
B.
Such device shall be designed and installed so as to
avoid dead air space, detect smoke and activate the alarm, be reasonably free
from false alarm and provide visible indication that the alarm is energized.
C.
The alarm shall be clearly audible in sleeping spaces
with intervening doors closed.
